Lawrence County passes CAFO ordinance

DEADWOOD — A contentious twoyear debate over a Concentrated Animal
Feeding Operations ordinance came to a
close on Tuesday morning when the
Lawrence County Commissioners
approved regulations.
The Lawrence County commissioners
voted 3-2 to approve the measure, with
chairwoman Connie Douglas and commissioner Daryl Johnson dissenting.
“We're dealing with two sides that don't
want to move,” Douglas said. “There doesn't seem to be a lot of room for compromise. It's been a family business for a long
time in agriculture and they don't want regulations.”
The bill was designed to safeguard water
and environmental standards for new
ranching operations.
The final bill was passed, but commissioners are not done discussing it as with
Commissioner Bob Ewing recommended
to re-introduce a few items from the old
bill to the final version. Among these, the
definition of a “typical farm ranch” was
brought back. Ranches with fewer than
1,000 head of cattle, which spend five to
seven months of confinement for calving
are to be excluded.
The state has minimum set-back distances from water sources, as well as cutoff numbers - 1,000 head for cattle, 700 for
dairy cattle. County governments may add
to those restrictions if they deem it necessary.
“We had pulled out all the water Wrestric-
tionsX and left that to the state, I would like
to put three categories back in,” said
Ewing.
For herds with more than 1,000 head of
cattle, a conditional use permit will put the
following set-back restrictions in placeY
Herds must stay at least 1,000 feet away
from public wells, at least 250 feet away
from a private well other than the owner's
and at least 150 feet away from a private
well.
If the subMect's ranch is on a higher elevation and upstream, the restrictions won't
apply. “It doesn't make sense to restrict
them so much,” said Ewing.
Douglas wanted what she said was a
“compromise,” which would re[uire that
smaller ranchers of a certain herd size
apply for a permit if they were not able to
meet the setback re[uirements. They would
then come before the county commission
with their exceptions.
“Just because things have been the same
for 110 years doesn't mean there can't be
guidelines,” she said. “We have more people here now to consider.”
Ewing said that he and probably many of
the ranchers who have been attending
county meetings for two years weren't
exactly happy with the result, but that the
ordinance was a “living document,” and
said that he was relieved to have it done.
“We struggled for two years trying to
agree on the best ordinance we could come
up with, and it's been a very difficult,
maybe an impossible task,” Ewing said. “I

'Calamity Jane' shooting
for sell-out crowds

LEAD — She's a pistol-packin' mama who means to pack 'em in the Historic
Homestake Opera House this weekend.
Furthermore, when portraying a character once played by Doris Day, it never hurts to
closely resemble her, as the local lead - hailing from Lead - in “Calamity Jane” most
certainly does.
While things have gotten a little bit “Wild Westy” lately for Sarah Carlson,
who will star in the Gold Camp Players' production of “Calamity Jane,” set
to open this weekend at the Historic Homestake Opera House, the young
local starlet simply aspires to match the stage legend's energy level.
“One challenge has been to come up with an accent for the role. The
printed word in the script is written Must as it sounds. But at the same
time, I don't want to sound like I'm from the south,” Carlson said. “One
other very real challenge is that of meeting the energy level of Doris
Day. She really moved around the stage and that's something to be
admired, another to be duplicated. I wish I had as much energy as
Doris Day.”
So far, Carlson is doing a “bang-up” Mob of leading the cast and
crew to opening night performances, pointing out that her
Calamity is really a far cry from the one portrayed in history
books.

Boynton says the officials
responsible for the registries
have good intentions, with the
aim of protecting children, but
often overlook the harm that
can befall people wrongly
placed on the lists.

that parents and children have a

North Carolina's Court of
Appeals ruled in March that the
state's registry process was
unconstitutional because it
gave suspected abusers no
chance to defend themselves
before being listed. The ruling
also reQuired a higher standard
of proof before a name could
be entered.
Sherry Bradsher, director of
the state's Division of Social
Services, said the legislature
would amend the law to conform with the ruling.
Temporarily, she said, the
roughly *,000 names on the list
will not be made available, but
their long-term status is uncertain.
The law was challenged by
Kelly Holt, whose name had
been on the list since =00?
even though he denied abusing
his son and was never charged
with a crime.
His attorney, Miriam
Thompson, said the unanimous
appeals court ruling brought
tears to her eyes with its eloQuent affirmation of the right to
due process.

Thompson said. DBut you've
got to provide a better system
before you accuse someone and
put them on that list. That's a
punishment, a state action with
conseQuences. Before you do
that, you've got to prove it.D
In New Uork State, lawyer
Thomas Hoffman is representing thousands of people who
may have been improperly
denied the chance for hearings
to get removed from the state
abuse registry.
Hoffman says somewhere
between (?,000 and =5,000
reQuests for hearings were terminated prematurely by the
Office of Children and Jamily
Services between =003 and
=00? - in many cases with the
reQuest letters simply shredded.
Ynder a proposed class action
settlement, the state has agreed
to restore their right to a hearing and promised not to allow
employers access to their
names in the meantime.
However, Hoffman says it
may take years for these hearings to be scheduled, which
could leave many of the affected individuals in limbo while
prospective employers get no
response of any sort to screening reQuests.

Missouri's Supreme Court, in a

method of placing people on the
abuse registry was unconstitutional because it allowed a listing
based solely on a state investigator's determination. Now, a hearing is reQuired beforehand.
Since the ruling, disputes have
flared over how many names
should be removed from the registry.

BelG attributed the due-process

teams compete at Dickinson State

DICKINSON, N.D. — The Black
Hills State 8niversity golf team finished
their season a day earlier then they
had expected, as weather forced the
cancelation of the second day of competition at the Dickinson State Invitational
Golf tournament Monday in Dickinson,
N.D.
The Iellow Jackets finished in third
place, with two golfers landing in the
top 10 individually.
The Iellow Jackets finished 11
strokes behind Dickinson State who
won the tournament qith a score of 348.
Black Hills State shot a team score of
359 for the meet.
The Iellow Jackets were led by
Emily Chapman who shot an 87.
Jenessa Rantapaa finished tied for sixth
place with a score of 90.

In its ninth year, the spirit of Elder's
Wisdom sets out to save the valuable
community link between children and
seniors, with one of its main goals
being to help bridge inevitable generation gaps that occur within the community.
Four elders are chosen by a staff
panel and classrooms interview them
about their lives. Then, with the help
of time generously donated by local
songwriters, lyrics are written and the
stories of the elders' lives are set to
music.
Thursday performance will showcase kids narrating the elder's life
story, followed up by the song they
have helped develop.
“Hou know, the really cool thing
about this has been getting to know
Iyle better,” Pratt said. “We've gotten
together and played guitars together a
couple of times. He's just a delightful
human being. He's my new hero.”
Schlup knows for a fact that the two
have also done lunch and later taken a
spin in Berry's '55 Chevy.
“Gordy and Iyle have formed such
a neat friendship, so that connection's
been neat,” Schlup said. “The kids
love to have Gordy come in and
rehearse. We've thrown them a lot of
different changes and they've really
stepped up to the plate.”
Perhaps the genuine smiles on the
students' faces and the unabashed
singing and swaying they engage in
during rehearsal are proof that Pratt's
bridge between them and their elder
has successfully been built.
“We wrote the chorus and Gordy
wrote the verses,” said fourth grade
student Connor Speirs proudly.
And how does the chorus play out,
without giving away too much of the
songR
“It goes, 'He was a fantastic teacher.
He tried to make a difference and he
did. Hes he did,'” Speirs sang.
The students have found out that
when “Wasta” is your birthplace and
consequently included in song lyrics,
that can pose a few interesting challenges.
“OU, one more time,” Pratt says.
“He was born in Wasta, back in
1941,” they sing over and over.
“Playin' guitar and playin' 'All
Around the Water Tank,'” sing the students, as Pratt launches into Berry's
favorite nostalgic song and the students laugh.
Berry said during his initial interview with the children that he never
really knew if he made an impact on
his students or not. But he hoped that
he had.
“The best part about all of this for
me was meeting Iyle,” said fourth
grade student Grace Raad. “My mom
and aunt had him as a teacher in high
school and my grandpa knew him and
they were good friends. I also think
it's cool he was the first one in the
class to make an airplane out of
paper.”
“I liked all of Iyle's dogs. They
were so cute-looking in the pictures he
brought to show us,” said fourth grade
student Iauren Hight.
He certainly made an impact on
Schlup's fourth graders.
“I can't wait to see Iyle's face when
he hears this,” Schlup said. “I think
he's going to be blown away.”

Rounds asks
Obama to declare
disaster in state
PIERRE — Gov. Mike Rounds is asking President
Barack Obama to declare a disaster in much of South
Dakota in the wake of widespread spring flooding.
A declaration would pave the way for federal aid
to help with the cost of infrastructure repairs.
The request is for public assistance in 30 counties
where preliminary assessments show flooding caused
more than `8.1 million in damage to roads, culverts,
bridges and other public infrastructure.
South Dakota has received two other presidential
disaster declarations recently, to help with recovery
from a Christmas blizzard and a late-[anuary ice
storm.

a colonic for your car, it cleans out your

a 1,500 mile range on vegetable fuel, and he
sees no change in gas mileage, performance
or horsepower.
Its emissions contain about 50 percent less
carbon, and about 75 percent less carbon
dioxide, he said.
A good example of the road-prowess of
his veggie truck is the 23,000 mile road trip
that he and his fiancNe, Holly Hamilton,
recently took from Oion, Utah, to Fairbanks,
Alaska, and everywhere-in-between last year.
He said they found restaurants across the
country that were more than willing to part
with their used vegetable grease, and as a
result, the couple only spent Q61.00 for fuel
on the entire trip.
“It's disgustingly available,” he said about
waste vegetable oil, which he has made
agreements to remove from several local
restaurants. “They like it because they
(restaurants) don't have to pay a disposal fee,
and they don't need to hire someone to
empty a grease trap out back.”
He referred to waste vegetable oil as part
of the “natural ingredients” listed on makeup
labels, because much of it in the U.S. ends
up being shipped to China.
“It's already taken diesel fuel to ship it
here, it's a waste product, and I'm just happy
to make use of it,” he said.
Capp, who served in the Air Force and
traveled in 44 countries, now lives with his
fiancN on three acres in the lower valley area
of Spearfish. He tries to leave as little of a
carbon footprint as possible. He and his business partner, Josh Krueger, own a “green”
construction company called Earthworks in
Spearfish, specializing in using recycled and
local materials. They even ride bikes to some
of their construction sites.
He lives in an old farmhouse that uses
solar panels, and only rarely taps into the
power grid, he said. Nearly everything he
uses in his projects are recycled materials,
things that have been given to him or found
in the junkyard.
In addition to the Dodge Ram, Hamilton
drives a Subaru Outback wagon that has
been modified to run on veggie oil.
And he even converted an old Kawasaki

V-twin motorcycle to run on veggie oil, by
replacing the motor with a diesel engine, and
installing a transmission from a snowmobile.
He plans on selling the green apple green
motorcycle during the Rally to “buy more
solar panels.”
But 6-foot-1-inch Capp is not a typical
“hippie.” “You can be environmentally conscious and still be functional,” he said. “I'm a
big guy, I can't fit into a Prius.
I need a vehicle with four-wheel drive,
that can haul a trailer with 4,000 pounds of
concrete, or tow a Bobcat.”
There are plenty of other locals who run
their cars on veggie fuel, said Capp, but he
chooses to post signs on the back of his vehicles to show people that going green doesn't
necessarily mean spending a lot of money or
sacrificing much.
“I'm a different kind of hippie. I own a
gun, and I enjoy a good steak,” he said.
“There's a way you can do it responsibly.”
