The Brazilian market is the fifth largest global market for
automobile manufacturers. Conditions are extremely favorable towards Brazil, with its main economic foundations stabilized and constant expansion of the domestic
market. From the beginning of 2003 until May 2011, 48.7
million people moved up into the classes A, B and C in Brazil, an increase of 47.94%, almost the population of Spain.

To meet the demands of industrial manufacturing in
Bahia, made up of companies already present, as well as
those that will be installed or be created in the State, the
automotive area of SENAI CIMATEC also works with
provision of specialized technical services, consulting and
applied research projects. To this end, we highlight the
following laboratory facilities: motor dynamometers tear
down for motor evaluation; roll dynamometer; laboratory
facilities (rig tests) for testing, testing and development
systems; automotive systems, on-board automotive

PROAUTO - Programa Especial de Incentivo ao Setor Automotivo da Bahia
PROAUTO - Special Program for the Incentive of the Bahian Automotive Sector
Lei nº. 7.537/1999
Law No. 7.537/1999
Finalidade: estimular a implantação e o desenvolvimento de empreendimentos industriais desse
setor, de relevante interesse para a economia do Estado.
Purpose: to stimulate the implantation and the development of industrial enterprises in this sector, which are of relevant interest to the State economy.
Beneficiados: empresas fabricantes de veículos automotores, denominadas empresas beneficiárias principais, que se comprometam, isoladamente ou em conjunto com seus fornecedores,
a utilizar métodos, sistemas e tecnologias avançados, compartilhados, no que couber, com
órgãos, agências e universidades locais.
Beneficiaries: Manufacturers of motor vehicles, denominated main beneficiary companies, that
commit themselves, alone or in conjunction with their suppliers, to using methods, systems and
advanced technology, shared, as appropriate, with bodies,
agencies and local universities.
Incentivos:
• Desoneração do imposto estadual (ICMS) na aquisição de bens destinados ao ativo fixo, nas
seguintes hipóteses:
• Nas operações de importação de bens do exterior;
• Nas operações internas relativas às aquisições de bens produzidos neste Estado;
• Nas aquisições de bens em outro estado, relativamente ao diferencial de alíquotas.

I - Crédito presumido de até 100% do ICMS do saldo devedor do ICMS apurado em cada mês,
no período de 15 (quinze) anos, a partir do início das operações, para empreendimentos de
relevante interesse para o Estado, habilitados como beneficiários principais, vinculado a um financiamento de capital de giro com recursos do Fundo de Desenvolvimento Social e Econômico
– FUNDESE, previsto no artigo 5º, inciso VII, da Lei 7.537/89, conforme abaixo:
I - Tax rebates of up to 100% of the ICMS of the outstanding ICMS balance defined in each
month, within 15 (fifteen) years from the start of operations, for projects of significant interest
to the State, qualified as a primary beneficiaries linked to a working capital financing from the
Social and Economic Development Fund - FUNDESE under Article 5, Paragraph VII of Law
7.537/89, as
follows:
“VII - a empresa beneficiada poderá optar pelo pagamento antecipado das parcelas mensais
recebidas ou dos saldos devedores anuais do empréstimo:
a) nos financiamentos liberados nos primeiros 72 (setenta e dois) meses de operação do
empreendimento, à taxa de desconto de 98% (noventa e oito por cento) sobre o valor de face
dos títulos de crédito;
b) nos financiamentos liberados a partir do 73º (septuagésimo terceiro) mês, pelo método do
valor atual da dívida, descontada pela taxa média de juros praticada pelo mercado interbancário
na semana anterior ao pagamento da antecipação, acrescida de até 5 (cinco) pontos percentuais;”
“VII -the company benefited may opt for advance payment of monthly installments received or
annual debit balances of the loan:
a) In financing released in the first 72 (seventy two) months of business operation, the discount
rate is of 98% (ninety-eight per cent) of the face value of the securities;
b) In the financing released from the 73rd (seventy third) month, by the present debt amount
method, discounted by the average interest rate charged by the interbank market in the week
prior to the payment of the advance, plus five (5) percentage points;”
The project shall be submitted for approval by FUNDESE Deliberative Council.

The financial incentives, except for the financing of working capital, are extended to the
automaker’s suppliers;

The financing of working capital shall obey the following criteria and conditions:
I - Term of benefit fruition of up to 15 (fifteen) years;
II - Amortization term of up to 12 (twelve) years

I - Prazo de fruição do benefício de até 15 (quinze) anos;

II - The issuing of ICMS in the successive internal operations and in those arising from imports,
with the goods listed below, their final destination being automobile manufacturers premises, the
main beneficiaries of PROAUTO, is deferred until the time the manufactured products are sold:
a) Inputs in general, to be used for the manufacture of:
I - automotive vehicles;
II - automotive parts and components.
b) new imported automotive vehicles, parts and components, for resale;
c) locally made parts and components, for resale;
d) goods for capital assets, including new automotive vehicles, for the beneficiary companies.
• The deferral applies to raw materials, intermediate products, packaging materials, parts,
components, assemblies and subassemblies, finished and semi-finished products, tires and
accessories.
• The deferral is extended to transactions made between the automotive vehicles manufacturer’s
suppliers.
II - O lançamento do ICMS incidente nas sucessivas operações internas e nas decorrentes de
importação, com as mercadorias abaixo relacionadas, com destino final a estabelecimentos
fabricantes de veículos automotores, beneficiários principais do PROAUTO, fica diferido para o
momento das saídas dos produtos por eles promovidas:
a) insumos em geral, destinados à fabricação de:
I - veículos automotores;
II - partes, peças e componentes automotivos.
b) veículos automotores novos, partes, peças e componentes importados, destinados à revenda;
c) partes, peças e componentes nacionais, destinados à revenda;
d) bens destinados ao ativo fixo, inclusive veículos automotores novos, das empresas beneficiárias.
• O diferimento se aplica às matérias-primas, produtos intermediários, materiais de embalagem,
partes, peças, componentes, conjuntos e subconjuntos, acabados e semi-acabados, pneumáticos e acessórios.
• O diferimento é extensivo às operações efetuadas entre fornecedores do fabricante de
veículos automotivos.
III - The tax credits accumulated by suppliers of the automotive vehicle manufacturers, the main
beneficiaries of PROAUTO, will be transferred, in proportion to the deferred outputs, for these
companies in the manner and under the conditions laid down in the special tax regime.

and the State.

A operacionalização dos benefícios será definida mediante formalização de contrato entre a
Empresa e o Estado.
Tax credit in the amount corresponding to the following percentages of the outstanding ICMS
balance assessed for each month of operation:
• 98%, from the 1st to the 6th year of operation;
• 90%, from the 7th to the 15th year of operation.

Crédito presumido no valor correspondente aos seguintes percentuais do saldo devedor do
ICMS apurado em cada mês de operação:

The perception of the above benefits shall depend on why the projects are approved by
FUNDESE Deliberative Council Resolution and on which of the following requirements they fit
into:
I - location within the State economy strategic interest areas;
II - quantity of jobs, direct or indirect, that the enterprise can generate;
III - volume of the total investment for the enterprise and amount of vehicles produced;
IV - integration and virtualization of productive chains and of commercialization, including for
abroad;
V - productive processes degree of technological development;
VI - the company responsibility in regard to its level of social interest in the community where it
intends to work.
A percepção dos benefícios acima dependerá de que os empreendimentos sejam aprovados
em Resolução do Conselho Deliberativo do FUNDESE e enquadrados em um dos seguintes
requisitos:
I - localização dentro das áreas de interesse estratégico para a economia do Estado;
II - quantidade de empregos, diretos ou indiretos, que o empreendimento possa gerar;
III - volume do investimento total do empreendimento e quantidade de veículos produzidos;
IV - integração e verticalização de cadeias produtivas e de comercialização, inclusive para o
exterior;
V - grau de desenvolvimento tecnológico dos processos produtivos;
VI - responsabilidade da empresa quanto a aspectos de interesse social na comunidade em que
pretende atuar.
The companies qualified as principal beneficiaries, in transactions with other PROAUTO nonqualified companies:
a) 75% (seventy five percent) of tax, in the first 5 (five) years of production;
b) 37.5% (thirty seven point five percent) of tax from the sixth to the tenth year of production.
Às empresas habilitadas como beneficiárias principais, nas operações com outras empresas não
habilitadas ao PROAUTO:
