In 2015 we advised Members about the EU funding opportunities under the title of ‘Portugal 2020’. (See UPDATE editions from February
and October 2015). Together with the project management company
Neomarca and event organisers LPro, we held seminars on the subject
which were well attended and which saw many people with new business ideas, or expansion plans, seek advice about the opportunities to
attract funding for their ideas.
An opportunity has now arisen for Associations to present
projects
under
the Portugal 2020
banner,
under
which they will
be able to attract
funding in the
area of “New Business Development
and Entrepreneurship”. Essentially
this means that
Associations can
apply for grant
funding to help them encourage and support their Members who
are looking to start a new business. We have submitted an application for consideration by the government which, if successful,
will enable us to develop a network of support and advisors to assist afpop Members who are looking to develop new businesses
in the Algarve and also to then present their plans and applications for funding.
As Members know, afpop is an Association of Members and is not
a business association. However this does not preclude us from applying for this funding, provided that we make one small addition to the
Statutes, which will develop the aims of the Association under Article
6 – “Objectives” - to establish the aim of the Association in assisting
our Members to develop their new business interests. The details of
2015 unterrichteten wir Sie über Möglichkeiten einer EU-Finanzierung
für Firmen im Rahmen von Portugal 2020 (s. UPDATEs Februar u. Oktober). Gemeinsam mit der Projektmanagement-Firma Neomarca und
dem Veranstalter LPro haben wir dazu Informationsveranstaltungen
durchgeführt, die sehr gut besucht waren. Viele Leute mit neuen Geschäftsideen oder Expansionsabsichten suchten Rat zu den Möglichkeiten der Finanzierung ihrer Vorstellungen.
Für Vereine gibt es jetzt ebenfalls die Möglichkeit, bei Portugal
2020 Projekte vorzustellen, um Finanzierungen im
Rahmen von “New
Business Development and Entrepreneurship” zu
erhalten. D. h. dass
Vereine Zuschüsse
beantragen können, um mit ihrer
Hilfe
diejenigen
ihrer
Mitglieder
ermuntern und unterstützen zu können, die ein Geschäft gründen
wollen. Wir haben bei der Regierung einen entsprechenden Antrag
gestellt. Bei Erfolg können wir dann ein Unterstützungs- und BeraterNetzwerk aufbauen, das afpop - Mitgliedern, die in der Algarve eine
neue Firma gründen wollen, helfen soll, damit sie dann auch ihre Pläne
und Finanzierungswünsche einreichen können.
Wie Sie wissen, ist afpop ein Mitgliederverein und keine Firmenvereinigung. Dies schließt uns aber nicht von der Beantragung dieser
Finanzhilfen aus, vorausgesetzt, wir ergänzen den Artikel 6 unserer
Satzung – Ziele – dahingehend, dass eines der Ziele des Vereins ist,
unseren Mitgliedern bei der Entwicklung neuer Geschäftsideen zu

HALLO
As you will read in the accompanying report of the President
our membership figure has not seen such growth for a long
time. This increase is owed in part to existing members as is
indicated by the fact that in 2015 many more credits of €5 for
recruiting a new member are given out than the years before.
As we have believed always in the Management Council, this
shows that at the one hand our members are content with the
performance of their Association and on the other hand, that
content members are really our best advertising medium. Keeping our performance not only at the same level, but to continue
to improve it and to develop new possibilities for our members,
afpop certainly needs money and this means mainly the members subscriptions. Some of you feel that these are ridiculously
low, but of course not all. Certainly there will come the day when
the subscriptions must rise, but the more members we have the
further this day is away. Therefore please continue to promote
your Associaiton. Last year´s results in particular show that your
efforts are fruitful!
As is usual in February, you will find in this edition some information about the AGM and some information about changes to the
afpop office.
In March our garden enthusiasts can extend their knowledge
concerning garden plants in our climate here.
We have a report about the IRS tax seminars and provide the
dates for this years tax returns, and for the BLiP too we have now
the dates.
There is an update about the cooperation between afpop and
the University of the Algarve.
Further we have reports about the seminar about Dignified Dying and the Health Forum.
Another garden day – with a sporty flavour! – is awaiting you in
June, add it to your diary!
Our member Rod Frew informs us some more about the nearly
forgotten St Vincent.
Once more again we have our long runner – driving licences;
this time about changing and new applications for the Portuguese
driving licence.
Our Council Member Dr Eduardo Serra Jorge explains the actual
legislation to dashcams and other sorts of video surveillance and
we explain how to deal with the electronic rental receipts.
Additionally you can read an article about the possible oil exploration off and on shore the Portuguese coast lines.
In our series about sustainability matters, Anabela Macieira promotes bamboo as an alternative to other wood and wood products.
Our Area Event Organisers have the final word, amongst others
with a plan for the next afpop trip, this time to Coimbra.

Wie Sie im nebenstehenden Bericht des Präsidenten sehen können, war
unser Mitgliederzuwachs im letzten Jahr so groß wie lange nicht mehr.
Dass dieser Zuwachs zu einem guten Teil unseren Mitgliedern zu verdanken ist, sehen wir auch daran, dass 2015 erheblich mehr Gutschriften über
€ 5 für die Werbung eines neuen Mitgliedes erteilt wurden als früher. Das
zeigt aber auch, dass wirklich – wie wir im Rat immer vermutet haben –
unsere Mitglieder zum einen mit den Leistungen des Vereins zufrieden
sind, und zum anderen, dass zufriedene Mitglieder tatsächlich unser bester Werbeträger sind. Um das Niveau unserer Leistungen nicht nur auf
dem gegenwärtigen Stand zu halten, sondern stetig zu verbessern und
für die Mitglieder auch neue Möglichkeiten zu erschließen, braucht afpop
natürlich Geld, und das heißt vor allem die Beiträge der Mitglieder. Manche von Ihnen halten diese Beiträge für lächerlich niedrig, aber eben nicht
alle. Irgendwann wird sicherlich der Beitrag erhöht werden müssen, aber
je mehr Mitglieder wir haben, desto später kommt dieser Zeitpunkt. Also
machen Sie weiter so, gerade das Ergebnis des letzten Jahres zeigt, dass
Ihre Bemühungen fruchtbar sind!
In dieser Ausgabe finden Sie natürlich einige Informationen zur JHV
und zur Erweiterung des afpop - Büros.
Unsere Gartenfreunde können ihr Wissen hinsichtlich der Bepflanzung
von Gärten in unseren Breiten im März erweitern.
Wir berichten über die IRS-Steuerseminare und geben Ihnen auch die
entsprechenden Daten für dieses Jahr, und für die BLiP haben wir jetzt
auch den Termin.
Neuigkeiten gibt es auch zur Zusammenarbeit von afpop mit der Universität der Algarve.
Ferner bringen wir Berichte zum Seminar über „Würdiges Sterben“ und
zum Gesundheitsforum.
Ein weiterer Gartentag – mit Sporteinlage! – kommt im Juni, merken Sie
ihn schon mal vor!
Unser Mitglied Rod Frew erzählt noch einmal ausführlich über den fast
vergessenen St. Vinzenz.
Diesmal ist auch wieder unser Dauerbrenner dran – Führerscheine,
diesmal geht es um den Umtausch bzw. Neuerwerb der portugiesischen Fahrerlaubnis.
Die aktuelle Gesetzeslage zu Dashcams und anderen Arten der Videoüberwachung erläutert unser VR-Mitglied Dr. Eduardo Serra Jorge, und
wir erklären, wie Sie die Mietquittungen für Ferienwohnungen elektronisch einreichen müssen.
Ferner finden Sie einen Überblick über mögliche Ölbohrungen vor und
an der portugiesischen Küste.
In unserer Serie zur Nachhaltigkeit berichtet Anabela Macieira über
Bambus als Alternative zu Holz und Holzprodukten.
Zum Schluss kommen wie immer unsere Veranstaltungsbeauftragten
zu Wort, dabei auch die Planung für eine afpop - Tour nach Coimbra.

Report
des Präsidenten
I wish you all belated wishes for a healthy and prosperous 2016, and
hope that you had enjoyable Christmas and New Year celebrations
wherever you spent them. 2016 is now on us and the first month
has flown by and our next big event is the Annual General Assembly
which will be held in Portimão on Saturday 19 March (see article in
this edition).
As is traditional, I use my report in this first edition of UPDATE to
review our performance during the past year, in effect a summary of
my full report to the AGA. So how did we fare? In a nutshell, 2015 was
a “Bumper” year for your Association both in terms of membership
and finances.
Our overall financial results show a surplus of €12500, the largest
by far for the past ten years. The success last year was due to several
factors, all of which we must compliment the hard work and commitment made by our staff, our Councils and by the membership as a
whole, as everyone played their part in our success.
Firstly, our membership increased by 339 during the year, the
best since 2002, and we ended 2015 with 5750 members. We
attracted over 750 new members, the best for 8 years, and we
retained 92.5% of our members as of the start of 2015, the best
since comparable records have been kept. I mentioned in an earlier UPDATE, that I believed we were at the start of an upswing in
our membership, and with these final results, I am convinced we
are. The retained membership is due to both the diligent work
of our staff in maintaining the high level of services to our members as well as recognition by our members that afpop is a valuable service provider to those living in Portugal.
Secondly, our flagship event BLIPExpo 2015 was by far the best
ever both in terms of exhibitor and visitor satisfaction and in financial
results. This result is due to the hard work, innovative ideas and commitment to detail by our staff and others who helped make the event
a success and again I congratulate them.
Finally, our staff has to be complimented for keeping our Operating Costs under Budget, no mean feat when many of the big ticket
items are beyond our control. The final result in the costs column
is about a €3000 under spend, out of a total budget of just under
€300000 – maybe a small percentage but an excellent result and a
big help in the overall surplus.
I would also like to comment on the management of your Association. We now have 7 permanent staff in the Portimao office, most
of who have been contributing to our success for many years. Under
our CEO’s leadership, they are the invaluable core of our business,
and have full responsibility of the day to day operation of the Association. We have two Councils who provide strategic support to the
CEO, maintain an oversight of the progress of the Association and
provide guidance if and when required. The Management Council is
composed of the CEO and 8 volunteer members, four being in full
time employment and two based in the Lisbon area. It meets once a
month (except August) and of course for the AGA. Overall attendance
during 2015 was nearly 80%. The Fiscal Council is composed of 3 volunteer members, at least one of whom attends each Management

immer Sie gerade waren. Das neue Jahr ist nun auch schon wieder über einen Monat alt und unser nächster wichtiger Termin ist die Jahreshauptversammlung am Samstag, 19. März, in Portimão (s. auch die folgenden Seiten).
Traditionell ist mein Beitrag in dieser ersten UPDATE-Ausgabe des Jahres
ein Rückblick auf das vergangene Jahr, im Endeffekt ist er eine Zusammenfassung meines Berichtes für die JHV. Wie also erging es uns? Kurz gesagt
war 2015 ein „bombiges“ Jahr für unseren Verein, sowohl hinsichtlich der
Mitgliederzahl als auch der Finanzen.
Unser Gesamtergebnis weist einen Überschuss von € 12.500 aus, bei weitem der höchste in den letzten 10 Jahren. Dieser Erfolg hat verschiedene
Gründe, die alle dem Fleiß und dem Engagement unseres Personals, der
Räte und der Mitgliederschaft insgesamt zu verdanken sind, die eine jeweils
eigene Rolle bei diesem Erfolg spielten.
Zum ersten wuchs die Zahl unserer Mitglieder um 339, das höchste
Wachstum seit 2002, und wir beschlossen das Jahr mit 5.750 Mitgliedern.
Wir konnten 750 neue Mitglieder gewinnen, das beste Ergebnis seit 8 Jahren, und wir konnten 92,5 % derer halten, die Anfang 2015 Mitglied waren,
das beste Resultat überhaupt. In einem früheren UPDATE erwähnte ich, dass
wir am Beginn eines Aufschwungs bei der Mitgliederzahl stehen und mit
diesem Endergebnis bin ich überzeugt, dass das tatsächlich so ist. Dass wir
so viele Mitglieder halten konnten, verdanken wir der unermüdlichen Arbeit
unseres Büroteams, das das hohe Serviceniveau halten konnte und ebenso
dem Umstand, dass unsere Mitglieder afpop als hochwertigen Dienstleister
für in Portugal Lebende anerkennen.
Zweitens war unser Flaggschiff BLiPExpo 2015 bei weitem die beste Ausstellung sowohl die Zufriedenheit von Ausstellern und Besuchern
betreffend als auch hinsichtlich des finanziellen Ergebnisses. Dies ist
wiederum der harten Arbeit, dem Engagement bis in die Details hinein
und neuen Ideen unseres Teams und Anderer zu verdanken, die alle zusammen diese Veranstaltung zu einem Erfolg machten und denen ich
hier noch einmal gratuliere.
Schließlich ist unseren Angestellten dafür zu danken, dass sie die laufenden Kosten unter dem Budget hielten, eine beachtliche Leistung, da
man nicht immer voraussehen kann, wann große Anschaffungen notwendig werden. Im Ergebnis lagen die Kosten € 3.000 niedriger als vorgesehen, bei einem Gesamtvolumen von € 300.000 – vielleicht nur ein
kleiner Prozentsatz, aber ein hervorragendes Resultat und ein großer
Beitrag zum Gesamtüberschuss.
Auch zur Geschäftsführung unseres Vereins möchte ich hier etwas sagen. Wir haben jetzt 7 Festangestellte im Büro in Portimão, die meisten
von ihnen tragen schon viele Jahre zu unserem Erfolg bei. Unter der Leitung unseres Geschäftsführers (Gf) bilden sie das Herzstück des Vereins
und tragen die gesamte Verantwortung für das Tagesgeschäft. Wir haben
zwei Räte, die den Gf in Strategiefragen unterstützen, die Aufsicht über
die Fortschritte des Vereins führen und bei Bedarf Orientierungshilfe geben. Der Verwaltungsrat (VR) besteht aus dem Gf und 8 Ehrenamtlichen,
von denen vier voll im Berufsleben stehen, zwei von ihnen arbeiten in
Lissabon. Sie treffen sich einmal monatlich (ausgenommen August) und
natürlich bei der JHV. Die Präsenz lag 2015 bei fast 80 %. Der Aufsichtsrat

Council meeting as well as their own Fiscal meetings. Members of both
Councils also attend ad hoc meetings as required. All Council members give
their time and commitment totally free of any cost to the Association. Without their contribution, it would be difficult to maintain afpop’s high profile
in the community.
There are many others who contribute to the overall success we have
achieved this past year. The Area Event Organisers who run all the social
events enjoyed by many of our members, our UPDATE editors who do an
excellent job producing a high quality product six times a year, and many
members who assist in translations, attracting new members and in many
other ways.
So where do we go from here? I do not intend too pre-empt our CEO’s
presentation of the Business Plan for 2016 which will be made at the AGA in
March (and available to any member who wishes to obtain a copy) and will
suffice to say that the surplus made in 2015 will be used for development of
new incentives which we hope will grow our Association in stature, in footfall and in delivering new and enhanced benefits to all members. To learn
more, I hope you will mark the 19 March in your diaries and join us at the
Annual General Assembly.

Report des Präsidenten
(AR) wird von 3 Ehrenamtlichen gebildet, von denen – abgesehen von
ihren eigenen Treffen – mindestens einer bei den Treffen des VR anwesend ist. Beide Räte treffen sich nötigenfalls auch zu Sondersitzungen.
Alle Ratsmitglieder stellen ihre Zeit und ihr Engagement dem Verein
unentgeltlich zur Verfügung. Ohne ihren Beitrag wäre es schwierig,
das hohe Ansehen von afpop zu erhalten.
Noch viele Andere haben zu dem Erfolg des vergangenen Jahres
beigetragen. Die Veranstaltungsbeauftragten, die zur Freude unserer
Mitglieder viele Veranstaltungen organisieren, unsere UPDATE-Redaktion, die sechsmal im Jahr ein hochwertiges Nachrichtenblatt liefert
und viele Mitglieder, die bei Übersetzungen und in vieler anderer Weise helfen und so neue Mitglieder anziehen.
Wie also geht es weiter? Ich möchte der Vorstellung seines Geschäftsplan für 2016 durch unseren Gf bei der JHV nicht zu sehr vorgreifen (er ist
für alle Mitglieder verfügbar) und begnüge mich damit zu sagen, dass
der Überschuss von 2015 für die Entwicklung neuer Impulse genutzt
wird, um Ansehen und Profil des Vereins zu steigern sowie neue und
verbesserte Vorteile für alle Mitglieder bieten zu können. Kommen Sie
am 19. März zu unserer JHV und erfahren dort mehr darüber!

Die 28. Jahreshauptversammlung findet am Samstag, den 19.
März 2016 im Hotel Jardim do Vau in Portimão statt. Die Anwesenheitsliste liegt ab 9.30 h aus, der Beginn der Sitzung ist auf 10.00 h terminiert. Wenn dann weniger als 50 % der Mitglieder anwesend sind,
wird die Versammlung um eine halbe Stunde vertagt und dann mit

One of the challenges with an Association likes ours, is how to develop new activities which will not necessarily directly benefit the
majority. Association’s funds of course are to be used to develop afpop for the benefit of all, so this new funding opportunity presents an
excellent opportunity for us to do something which develops a new
service for those Members who want it, without taking Members funds
to implement it.
Of course this does not alter the fundamental aims and mission of the
Association. afpop is, and will always be, an Association of Members and
remains dedicated to helping you as we always have done. Nor does this
alter the governance of the Association or alter our non-profit status.
What it does bring is a platform from which to work more closely with
businesses; raises the profile of afpop within the business community
and offers an opportunity to attract extra funding for the Association.
If the application is accepted, there will be a short presentation on
the afpop Business Network at the AGM in March, together with an
article in the April edition of UPDATE.

New Office Space
Members who have visited the
afpop office in the last three
years, will know that the main
reception has always been a
little limited for space – mainly
due to a pre-existing meeting
room on the upper floor. Whilst
this has made the reception
are functional, it wasn’t ideal –
particularly if there are people
waiting to see one of the Membership Services team.
We are pleased to announce
that we have now been able to
remove the meeting room and
expand the space available to welcome and speak to Members. This
has not only made for a more comfortable area in reception, but has also
meant that we have been able to create a third reception desk and therefore
are able to respond to more Members at the same time.
We look forward to welcoming Members into the newly refurbished
afpop office.
Discover Portugal course
In 2015 we advised Members of a new initiative with the University of
the Algarve (UAlg) intended to encourage expatriates to use the services and course on offer at the University. As this was something that
was discussed between our two organisations, it was only fair that the
first people to benefit from this collaboration should be afpop Members,
before making the opportunity available to the general foreign resident
community.
The course that we agreed upon is the “Discover Portugal” course
that we advised Members about last year and which 16 Members have
expressed a desire to attend. I am delighted to announce that the
course has now been finalised and will commence on the 31st March.
The course will take place one day each week for the next 13 weeks,
full details of which are available from the afpop office.
We have agreed with UAlg that we will now make the course available to the resident community and a Press Release will be issued
shortly to that effect. If there are any afpop Members who would like
to register ahead of that we ask that you contact the afpop office,
where full details of the course can be obtained.
We are proud to bring this initiative together with the University.
Hopefully this will be the first of many courses for the future aimed at the
foreign resident community, further promoting the links we are trying to
foster between the expatriate and Portuguese communities in the region.

Wenn Sie das afpop - Büro

Empfangsbereich ein wenig eingeengt war – hauptsächlich wegen eines dort
abgetrennten
Raumes.
Der Empfangsbereich war
dadurch zwar funktional,
aber nicht ideal – besonders wenn man warten
musste, um jemand vom
Team zu sprechen.
Erfreulicherweise konnten wir jetzt diesen separaten Raum beseitigen und
so mehr Platz für das Gespräch mit den Mitgliedern gewinnen. Dadurch
wurde der Empfangsbereich nicht nur komfortabler, sondern wir konnten auch einen dritten Schreibtisch aufstellen und können so mit mehr
Mitgliedern zur gleichen Zeit sprechen.

Vorlesungsreihe Discover Portugal
2015 haben wir über unsere Initiative mit der Universität der Algarve (UAlg) berichtet, die die Ausländer ermutigen soll, die Angebote
und Kurse der Universität anzunehmen. Da dieses Programm zwischen unseren beiden Organisationen diskutiert und entwickelt wurde, ist es nur fair, dass die afpop - Mitglieder noch vor der übrigen
Ausländergemeinde als erste davon profitieren.
Wir haben uns auf die
Vorlesungsreihe Discover
Portugal geeinigt und sie
im UPDATE angekündigt,
16 Mitglieder haben bereits ihr Interesse an der
Teilnahme bekundet. Die
Kursvorbereitungen sind
jetzt abgeschlossen und die Vorlesungsreihe wird am 31. März beginnen, einmal wöchentlich, 13 Wochen lang.
Wir sind mit der UAlg übereingekommen, den Kurs ab jetzt für die
gesamte Ausländergemeinde zugänglich zu machen, hierzu wird in
Kürze eine Pressemitteilung herausgehen. Wenn Sie sich noch vorher
anmelden wollen, wenden Sie sich bitte ans afpop Büro, wo Sie auch
Einzelheiten erfahren können.
Wir sind stolz darauf, dass wir diese Initiative zusammen mit der
Universität auf den Weg gebracht haben. Dies wird hoffentlich nur
die erste von vielen Vorlesungsreihen für die Ausländergemeinde
sein und unsere Bemühungen unterstützen, die Kontakte zwischen
Ausländern und der portugiesischen Gesellschaft zu festigen.

Forum Event at
Quinta dos Vales
As the Springtime planting period approaches, many people will be
looking at their gardens and deciding what to do, what to plant and
what to change this year. On 9th March, Marilyn Medina Ribeiro, the director of landscape design company Waterwise Gardens, will provide
information and advice to those who are looking for ideas or inspiration for their gardens in the Algarve. As many people will have already
discovered, there is a big difference to gardening in the Algarve compared with more northerly climates.

University Life Skills coaching
In 2015 we discussed with the University of the Algarve (UAlg) the opportunity to use the wealth of experience of the foreign resident community
to enhance the work done by the University. We are delighted to announce
that under the heading “Sharing Experiences”, five afpop Members will be
presenting their experiences to students at the University. The first of these
sessions was presented by afpop Member Mike Gerber, who was featured a
few years ago in the “Spotlight On” feature in UPDATE magazine. Four more
afpop Members, Chris Hughes, David Thursfield, Geoff Bertenshaw and
Steve Wilson, will be presenting to students in February and March.
The experiences of the foreigner residents who have made the Algarve
their home can be great value to the University and we are proud to have
been asked to work with them to approach our Members on this pilot project.
Once the initial presentations have been held in what we are calling
the ‘Spring 2016 Programme’, we will assess the value of the sessions
with the University staff and the 5 presenters and decide on the next
step in the programme.
Any afpop Members who would like to know more about the programme should contact the afpop office in the first instance. Asking
for information or meeting with the University staff does not carry any
obligation to continue, so Members should not feel that an enquiry
commits you to presenting. We know that there are many afpop Members with work or life experiences that are of interest to those people
currently in education and who are looking to make their own mark
in the world. We believe that this programme is a way for the skills of
Members to contribute to the growth of the next generation.
BLiP 2016 Love it … LIVE IT!
This event, entitled Making the most of your garden in the Algarve: will give simple tips for improvements to your garden which
will save you time and money. The event will be held at the Quinta
dos Vales Winery, Estombar near Lagoa on Wednesday 9th March
starting at 10.30 (registration 10am).
Marilyn will introduce some of the joys and challenges of gardening
in the Algarve, while outlining simple tips for making the most of your
garden in this climate. Touching briefly on design and renovation, the
main emphasis will be on easy-to-implement methods which will give
your garden an instant boost, including composting, mulch, propagation, pruning and watering.
It is intended that there will also be a plant ‘surgery’ within the event
where those attending can bring along ‘ailing’ plants or seek solutions
to other garden problems for Marilyn to proffer her advice.
Places are limited so booking is essential – please contact the afpop

euros for afpop Members and 15 euros for non-members, payable in
cash at the event or by cheque or bank transfer prior to the event. A
surprise gardening gift will be given to all guests.

Our annual Better Living in Portugal will take place this year on the weekend
of 8th and 9th of October and will once again be held at the Portimão Arena. Over the coming weeks information will be added to the BLiP website
www.bliportugal.com or from the link on the main afpop website.
BLiP 2016 will see continued development of the layout and format
that we have used for the last two years and which has been so well
received by exhibitors and visitors alike. We will continue to make it attractive for the smaller businesses to attend the exhibition and we are
committed to keeping costs as low as possible and are working with
the arena owners to find ways to make costs to exhibitors, whether
large or small, as affordable as possible.
In these difficult times we feel that it is more important than ever
to let customers know who is in business and the BLiP exhibition is a
great way to do exactly that.

afpop Garten-Forum in der Quinta dos Vales
Das Frühjahr naht und damit auch die Pflanzzeit. Viele werden wieder
in ihren Garten gehen und überlegen, was zu tun ist, was sie pflanzen
und was sie ändern wollen.
Am 9. März wird Marilyn Medina Ribeiro, Chefin der Landschaftsgärtnerei Waterwise Gardens, Informationen und Ratschläge für diejenigen bereithalten, die Ideen und Inspirationen für ihre Gärten im Algarve
suchen. So mancher hat nämlich schon bemerkt, dass es zwischen den

2015 besprachen wir mit der Universität der Algarve (UAlg) die Möglichkeit, den Erfahrungsschatz von hier ansässigen Ausländern zu nutzen, um
die Arbeit der Universität zu bereichern. Wir freuen uns, hier ankündigen zu
können, dass unter dem Titel Sharing Experiences fünf afpop - Mitglieder ihr
Wissen und ihre Erfahrungen an die Studenten der Universität weitergeben
werden. Die erste dieser Vorlesungen wurde von Mike Gerber gehalten, der
vor einigen Jahren in einem unserer „Brennpunkte“ im UPDATE vorgestellt
wurde. Weitere vier afpop - Mitglieder, Chris Hughes, David Thursfield,
Geoff Bertenshaw und Steve Wilson werden im Februar und März zu den
Studenten sprechen.
Die Erfahrungen der Ausländer, die in der Algarve ihr Zuhause gefunden haben, können für die Studenten sehr wertvoll sein, und wir sind
stolz darauf, zur Zusammenarbeit mit der Universität gebeten worden
zu sein und unsere Mitglieder an dieses Pilotprojekt heranzuführen.

nächsten Schritt im Programm beraten.

IRS Seminars report IRS-Seminar - Bericht
The 2016 afpop Seminars began in their customary fashion, with the
IRS Seminars presented in conjunction with euroFinesco. For the 20th
consecutive year, the two organisations have collaborated in January
and February to present information on the ever changing world of
tax reporting in Portugal and associated information.
Beginning in Lagos and then continuing in Tavira and Vilamoura, over
a hundred people attended the seminars, which gave details of the allowances and exclusions for tax payers submitting declarations for the 2015 tax
year, as well as indications of some changes that will occur in 2017 when reporting for the current financial year. This year also saw the return of the IRS
seminars to Cascais, with an event on the 12th February at the Hotel Baia.
The annual IRS Seminars are always a good way to start our programme
and we look forward to presenting more seminars before the summer on a
variety of subjects. More information is available in this edition of UPDATE.
We would like to thank the team from EuroFinesco for their cooperation once again.
Die afpop - Seminare 2016 begannen wie üblich wieder mit den EkSt.Seminaren, und auch im 20. Jahr wieder in Zusammenarbeit mit euroFinesco. Im Januar und Februar präsentierten wir wieder Informationen zur sich ständig ändernden Steuersituation in Portugal.
Über 100 Seminarteilnehmer fanden sich in Lagos und danach
in Tavira und Vilamoura ein, um alles zu Steuererleichterungen für
die EkSt.-Erklärung des Jahres 2015 zu erfahren und zusätzlich einige Vorankündigungen der Änderungen, die 2017 für das laufende
Steuerjahr vorgesehen sind. In diesem Jahr waren wir auch wieder
einmal in Cascais, die Veranstaltung fand am 12. Februar im Hotel
Baia statt.
Diese jährlichen Steuerseminare sind immer ein guter Start unseres Programms, und wir hoffen, vor dem Sommer noch weitere
Seminare über verschiedene Themen arrangieren zu können. Mehr
dazu in diesem UPDATE.

Due to medical commitments which could not be avoided, the Health
Forum ‘A Guide for Responsible Health’ in cooperation with Luzdoc,
will now be held in the last week of March. The actual date will be announced once the venue has been confirmed and any Member who
would like more information should contact the afpop office to register their interest. The forum will be free to afpop Members.
The first part of the event will be on the subject of Diabetes & Excess
Weight and will comprise 4 presentations on basic health care, the general causes for diabetes, nutritional advice and nursing care for diabetics.
The second half of the event will be an open forum, with a panel
of GPs taking questions on any subject from the audience. There will
also be an opportunity to speak to the medical professionals more privately once the formal seminar proceedings are complete.

The seminar in the Algarve will take place at the Municipal Library in
Tavira on 17 February and, subject to final confirmation, in Caldas da
Rainha at the Cultural Centre on 23 February. Both seminars will start at
10.30 (registration at 10.00). Entry is free to afpop Members and a charge
of 20 euros will be applicable to non-Members, payable at the seminar.

du Président, afpop n’a jamais enregistré pareille croissance du nombre de ses membres.
Cette performance est avant tout le fait des
membres actuellement inscrits; le nombre de
crédits de 5€ accordés pour le patronage d’un

en 2015. Ceci confirme d’abord que nos membres sont satisfaits de notre offre, ensuite qu’ils

La 28° Assemblée Générale Ordinaire se tiendra Samedi 19 Mars
2016 à l’Hôtel Jardim do Vau à Portimão. L’enregistrement ouvrira à
9h 30, l’assemblée débutera à 10 h 00. Si moins de 50% des membres
sont présents à l’ouverture, l’ouverture de l’assemblée sera reportée
de 30 minutes. Elle sera alors tenue avec les membres présents aux
termes de l’article 24, section II, Chapitre IV des statuts de l’afpop.

The dates to submit your IRS return forms regarding income from 2015
have now been released by the government. From this year both paper
and online submissions will be done in the same 2 periods, 1 period for
1st phase and one for 2nd phase.
The submission periods for your 2015 tax return, either in paper or
electronically, are as follows:
• During the month of 15 March to 15 April for the 1st phase
• During the month if 16 April to 15 May for the 2nd phase
- 1st phase is for taxpayers whose only source of income is
through salaries or pensions (including from abroad).

Please note: If you submit your tax return after the due date you will be liable to a
fine ranging from 100 to 2,500 euros, depending on the length of the late payment. If
the return is submitted more than 90 days late, you will also not be able to claim any
tax deduction or tax relief.

St. Vincent, the forgotten Saint
Cape St. Vincent, one of the major geographical
features of the Algarve with its millennia of history, The Monasterio de São Vicente de Fôra in Lisbon, St Vincent’s Anglican Church of the Algarve;
we are indeed surrounded by the name of St. Vincent. But who was he? Few, apparently, seem interested! There is a small statue of him in the little
Church of Nossa Senhora de Graça in Sagres but
little reference to him at the famous Cape that
bears his name, and all Guide Books, even Portuguese ones give but scant information about him.
This is particularly odd since he is, in fact, the Patron Saint of Lisbon and, almost as importantly to
some, the Patron saint of Wine Producers! Indeed
ask many Portuguese who the Patron Saint of
their capital is and some half of them will tell you
St.Antony. His Feast Day merits a public holiday
in Lisbon and poor St.Vincent’s Feast day (22nd
of January) is practically forgotten! Why is this?
Well perhaps one reason (but surely not!) is that
St.Antony of Padua, although canonised in Italy,
was Portuguese, born in Lisbon, and St.Vincent of
Zaragoza was born in Spain!
Vincent was, indeed born in Huesca, Spain,
in the latter part of the third century and early

in his life joined the Christian church in nearby
Zaragoza. He obviously caught the eye of the
Bishop, Valerius, and was appointed his Deacon.
Although Valerius was a devout Christian he was
a much older man and apparently suffered from
some sort of speech impediment. Vincent effectively became Valerius’ mouthpiece and seems
to have become even more outspoken than his
mentor in his Christian beliefs. So much so that
when they moved to Valencia they soon came to
the notice of the authorities in Rome and Emperor Diocletian ordered them to be arrested. They
were, of course, found guilty. Valerius, in view of
his age and infirmity, was released but exiled.
Vincent was horrifically tortured in an attempt
to make him renounce his faith; he resolutely
refused and in AD 303 was finally put to death.
This much seems reasonably well documented;
Prudentius, a Roman Christian poet who lived
about a century later, described Vincent’s martyrdom in an epic poem. Vincent’s eventual canonization was pre-congregational so the actual
date is unknown.

Electronic Receipts - Rent
In a previous issue of the UPDATE magazine, we informed Members about
the obligation to issue electronic receipts when renting your property for
holidays. From last November the receipts of long term rentals are also to
be submitted electronically on the Finanças website.
Property owners who rent their property long term and earn from
it over 838,44 euros a year, which covers the majority of cases, are
obliged to submit receipts electronically. But landlords over 65 are
exempt from this new law, they can mainly declare until the end of
January the amount received as rental income in the previous year.
This applies also to rural rentals such as farming land.
Those who are not over 65 but do not have access or do not wish to
use the internet may ask someone to do it for them, bearing in mind that
whoever does it for them has to do it online through “Portal das Finanças”.
For this to be possible without you giving out your personal details
to access your page at Finanças website, you may formally authorise a
person to issue your rental receipts from their own page. If the rental
contract was signed after April 1st 2015, it would have been submitted
to Finanças with form modelo 2. In this form you can actually identify
a person (such as your accountant, lawyer or agent) who will be doing
the electronic receipts on your behalf. If the contract was signed before April 1st 2015, you can still authorise someone to do the electronic
receipts for you by accessing your personal page at Finanças website.
Please note that there are penalties for not complying with this law,
with fines ranging from 150 to 3.750 euros.
If you do not yet have a password “senha” for the Finanças website, you should request it as soon as possible. To do this access www.
portaldasfinancas.gov.pt” at the very top of the page you have 3 options “Informação Institucional”, “Serviços Tributários” and “Serviços
Aduaneiros” you must choose the middle one “Serviços Tributários”
to access Finanças main site. Right in the centre at the top of the page
it asks if it is the first time you are using it and in blue you will see
“registar-me” (you must click on that). This will take you to an online
form where you need to insert your fiscal number, email, phone number and address. It will also ask you to choose a safety question and
answer it, in case you forget your password, you may also choose to
receive notifications by email or text message (SMS). At the end you
just click on “pedir senha” and it will be sent to you by post.

Vincent in der Algarve: wir sind tatsächlich umgeben von dem Namen St. Vinzenz. Aber wer war er? Offensichtlich sind
nur Wenige an ihm interessiert!
In der kleinen Kirche Nossa Senhora de Graça in Sagres steht eine kleine
Statue von ihm, aber an dem Kap, das
seinen Namen trägt, erinnert nichts an
ihn, und alle Reiseführer, sogar die portugiesischen, geben nur wenige Informationen. Das ist besonders seltsam, da
er tatsächlich der Stadtpatron von Lissabon und, für Einige noch wichtiger, der
Schutzpatron der Winzer ist! Fragen Sie
mal Portugiesen, wer der Schutzheilige
ihrer Hauptstadt ist, und die Hälfte von
ihnen wird antworten, es sei St. Antonius. Sein Festtag ist in Lissabon Stadtfeiertag, und der des armen St. Vinzenz
(22. Januar) ist praktisch vergessen! Wie
Elektronische Mietquittungen
In einer früheren Ausgabe des UPDATE informierten wir Sie über die
Pflicht, bei der Vermietung von Ferienwohnungen elektronische Quittungen auszustellen. Ab vergangenen November müssen auch die
Quittungen für Langzeitvermietungen elektronisch auf der Website
der Finanças eingereicht werden.
Immobilienbesitzer, die ihr Eigentum langfristig vermieten und dafür
mehr als € 838,44 pro Jahr einnehmen (was auf die meisten Fälle zutrifft),
müssen ihre Quittungen elektronisch einreichen. Vermieter über 65 Jahre
sind von dieser neuen Vorschrift jedoch ausgenommen, sie können den Betrag ihrer letztjährigen Mieteinnahmen bis Ende Januar angeben. Dies gilt
ebenso für die Verpachtung von z.B. landwirtschaftlichen Flächen.
Wer nicht älter als 65 ist, aber keinen Internetzugang hat oder dieses
nicht nutzen will, kann jemanden bitten, das für ihn zu tun. Das muss aber
in jedem Fall online über das Portal das Finanças geschehen.
Um dies zu ermöglichen, ohne ihre persönlichen Zugangsdaten zu Ihrer
Seite auf der Finanças-Website preiszugeben, können Sie eine Person formell autorisieren, Ihre Mietquittungen von deren eigener Seite auszustellen. Wenn der Mietvertrag nach dem 1. April 2015 abgeschlossen wurde,
wurde er wohl mit dem modelo 2 bei den Finanças eingereicht. In diesem

kommt das? Einer der Gründe könnte vielleicht sein (das kann aber
doch bestimmt nicht sein!), dass der heilige Antonius von Padua, auch
wenn er in Italien kanonisiert wurde, Portugiese und in Lissabon geboren war, und St. Vinzenz von Saragossa war gebürtiger Spanier!
Tatsächlich wurde Vinzenz Ende des dritten Jahrhunderts in
Huesca, Spanien geboren und wurde schon in jungen Jahren Mitglied
der christlichen Gemeinde im nahen Saragossa. Offensichtlich erregte
er die Aufmerksamkeit des Bischofs Valerius, der ihn zu seinem Diakon
ernannte. Valerius war ein frommer Christ, aber schon ein alter Mann
und litt offenbar unter einer Art Sprachstörung. Vinzenz wurde Valerius´ Sprachrohr und scheint mehr gesagt zu haben, als sein Mentor
in Glaubensfragen ausdrücken wollte, und zwar so viel, dass sie, als
sie nach Valencia gingen, bald den römischen Behörden auffielen
und Kaiser Diokletian sie einsperren ließ. Natürlich wurden sie schuldig gesprochen. Angesichts seines Alters und seiner Gebrechlichkeit
wurde Valerius zwar entlassen, aber ins Exil geschickt. Vinzenz jedoch
wurde schrecklich gefoltert, damit er seinen Glauben widerrufe. Er widerstand jedoch und wurde 303 hingerichtet. Dies scheint gut dokumentiert; Prudentius, ein christlicher römischer Dichter, der ungefähr
ein Jahrhundert später lebte, beschrieb Vinzenz´ Martyrium in einem
epischen Gedicht. Seine schließliche Heiligsprechung erfolgte lange
vor der Einführung des heute üblichen Verfahrens, das Datum ist daher nicht bekannt.

müssen eine Sicherheitsfrage und die Antwort darauf angeben (falls Sie Ihr
Passwort vergessen), und Sie können wählen, ob Sie Nachrichten per E-Mail
oder per SMS erhalten wollen. Am Ende klicken Sie auf pedir senha, worauf
Ihnen das Passwort per Post zugesandt wird.

Driving licence renewals
EU citizens who become resident in Portugal are
not required to swap their EU driving licence for a
Portuguese one straight away, they are however
required to register their Portuguese address with
IMT (Instituto da Mobilidade e dos Transportes). This
has to be done now in person as the IMT office
will need to see the original documents. You can
get more information in our Information Bulletin
P/04 which also explains the procedure. There are
some driving schools (check with your local ones)
that offer to do this registration for you, but they
will have to take your original documents/driving
licence with them for a day.
When your EU driving licence expires and
if you are still a resident in Portugal, you must
then renew it in this country, your country of
residence. You will then receive a Portuguese
(European format) driving licence which will
include your Portuguese address.
European driving licence holders whose
licence does not have a validity date and who
are residents in Portugal, must replace their
driving licence for a Portuguese one, within
two years of becoming a resident in Portugal.
When you renew a Portuguese driving licence,
you will keep it until you receive the new one
along with a document stating that your driving
licence is due for renewal. You can start the process up to six months before your licence expires.
On the other hand if you are exchanging your
EU driving licence for a Portuguese one, you will
be asked to surrender yours immediately and will
be provided with a document, or guia, that will
allow you to drive in Portugal. This document is
in Portuguese and it will not be accepted in another country. If you are intending to travel and
drive outside of Portugal, you should plan for the
renewal of your licence well in advance, or you
may apply for an International Driving Licence
(IDL) from ACP (Automobile Club of Portugal). The
validity of the IDL is normally for one year, except when it is based on the renewal document
“Guia”, in which case it will have the same validity
date as this document.

Points on Driving Licences
From June 1st 2016, the new law regarding penalty points on Portuguese issued driving licences will start. At first the drivers will be attributed
12 points as a starting base. After 3 years without
any penalties, the driver will receive another 3
points, always to a maximum of 15.
Any serious offence (see afpop brochure
Driving in Portugal) will deduct 2 points from
the existing points and very serious offences
will deduct 4. When it comes to drinking and
driving a serious offence will deduct 3 points
and a very serious one 6 points.
If a driver gets down to 2 points, they will have
to take a brand new driving licence from the beginning, through a driving school with the minimum amount of lessons as a first timer. If a driver
loses all the points, they will be banned from driving for 2 years at which time a new driving licence
must be taken, also from the very beginning.
Erneuerung von Führerscheinen

Sie ihn hier in Ihrem Wohnsitzland erneuern. Sie erhalten dann
einen portugiesischen Führerschein im europäischen Format,
in dem auch Ihre portugiesische
Adresse eingetragen ist.
Europäische Führerscheine
ohne Ablaufdatum, deren Besitzer in Portugal Residenten sind,
müssen ihren Führerschein innerhalb von zwei Jahren nach
Erwerb der Residência in einen
portugiesischen umtauschen.
Wenn Sie einen portugiesischen Führerschein erneuern, behalten Sie diesen solange, bis Sie
den neuen erhalten, und Sie erhalten ein Dokument, in dem bestätigt wird, dass Ihr Führerschein
in Bearbeitung ist. Sie können das
Verfahren bis zu sechs Monate vor
dem Ablaufdatum einleiten.
Wenn Sie andererseits Ihren EUFührerschein in einen portugiesischen umtauschen, müssen Sie diesen direkt abgeben und erhalten
dafür eine guia, die Sie zum Fahren
innerhalb Portugals ermächtigt.
Diese guia ist in portugiesischer
Sprache und wird in anderen Ländern nicht anerkannt. Wenn Sie also
verreisen und außerhalb Portugals
fahren wollen, planen Sie den Umtausch rechtzeitig oder beantragen Sie beim ACP (Automóvel Club
de Portugal) einen Internationalen
Führerschein. Dieser gilt normalerweise ein Jahr, außer wenn er auf
der guia beruht, dann gilt er ebenso
lange wie diese.

Neues Punktesystem
Ab 1. Juni 2016 tritt das neue Gesetz
zu Strafpunkten auf portugiesischen
Führerscheinen in Kraft. Der Fahrer
erhält als Start 12 Punkte. Nach 3 Jahren ohne Strafen erhält er weitere 3
Punkte bis zu maximal 15.
Bei jedem schweren Verstoß
werden 2 Punkte abgezogen, bei
sehr schweren Verstößen 4. Bei
Fahren unter Alkohol sind das 3
bzw. 6 Punkte.

Are in-car Video Cameras legal in Portugal?
This is a question that we have been asked several times recently and there is a difference between recording devices which are used for surveillance and
recreational reasons. We have asked Dr Eduardo Serra Jorge for a summary of the situation, which we publish here for Members’ information.
We only speak about video surveillance when the use of video surveillance
systems is connected with the protection of persons and/or property/assets. Any video surveillance (“videovigilância”) system for the purpose of
protecting persons and property, requires prior authorisation of the competent authority, which is CNPD (Comissão Nacional de Protecção de Dados).
The legitimacy for the request, as well as the location of the cameras will be
analysed in the context of the legalization procedure concerned.
However, the general principle is that it is not allowed to capture public
roads, common areas or the property of others or to control the employees.
The law does not forbid the accidental capturing or images of people who
are in the public spaces that we all use.
When the video systems are used a recreational activity, there is no need
to request any specific authorisation, nor to give any notification to any entity. Anybody can film the street and the buildings and persons in it. Those
persons, who are filmed and who are aware that they are, can always demand that their image is deleted. But, if the intention is expressly to capture
those images for surveillance purposes for the protection of persons and/or
assets, an authorisation must be requested.
The Portuguese law (namely articles 192 and 199 of the Criminal Code
and articles 6 and 7 of Data Protection Law), forbids:
Capturing images inside the vehicles without the consent of the persons
captured (for example capturing images of the employees of a company
without their consent);
Capturing images from the inside of the vehicle of the outside world and
people therein, without the consent of the persons concerned and prior authorisation of the competent authority.
In the event that you put the equipment inside your personal property
(for personal protection), you should when purchasing the equipment,
make sure that this device meets the legal regulations for the sector and the
manufacturer must provide such proof. Under a criminal proceeding and
when it is authorised by a judge who has analysed the particular circumstances of the case, such captured images could be used as evidence (in
accordance with the dominant jurisprudence). Under the Portuguese legal
system it cannot the assumed as a fact that video footage of an act can be
used as evidence, or part of any evidence. The specific facts of the case must
be analysed in order to conclude if the images can or cannot be used.
In fact, concerning those video surveillance systems aimed at the protection of persons and property, anybody can use it on their private property.
There is no need to request any specific authorisation nor to do any notification to any entity where those video surveillance systems cannot capture
images of the public street, of the property of other persons, of employees.
Even where the installation and maintenance of video surveillance systems in private property is not subject to specific authorisation nor any
notification to any entity, because there are contradictory judicial decisions
concerning the use of the images captured on pending procedures, it is advisable that the installation of video surveillance systems, even in private
property, is notified to CNPD precisely to ensure that the legal limits are respected and that the video surveillance systems are correctly installed.
Companies that sell this type of device/equipment, they are subject to
authorisation from the CNPD. The fact that the equipment is allowed to be
sold does not mean that it can be used for whatever purposes. Despite the
cameras being legally sold on the Portuguese territory, it does not automatically follow that it may be used for every and all purposes. It cannot be used
to gather data which is prohibited as stated by the applicable legislation.
CNPD is not currently authorising people or private entities to capture
images of the public street or on which is possible to identify or make identifiable a certain person through personal data. Therefore CNPD says that
a car cannot capture images through a Dashcam, if it is possible to identify
(directly or through a personal data such as the license plate) a person.

Sind Autokameras in Portugal erlaubt?
Wir haben unser VR-Mitglied Dr. Eduardo Serra Jorge gefragt, der hier eine Zusammenfassung gibt.
Wir sprechen nur über Videoüberwachung, wenn ein System zum
Schutz von Personen und/oder Eigentum/Vermögenswerten genutzt
wird. Jedes Videoüberwachungssystem (videovigilância) zu Schutzzwecken erfordert die vorherige Genehmigung der zuständigen Behörde CNPD (Comissão Nacional de Protecção de Dados). Die Legitimität
des Antrags wird beim Genehmigungsverfahren ebenso geprüft wie
die Standorte der Kameras.
Im Prinzip ist es jedoch nicht erlaubt, öffentliche Straßen und Plätze, Anwesen von Anderen zu erfassen oder Angestellte zu kontrollieren. Zufallsaufnahmen oder Bilder von Personen, die den öffentlichen
Raum nutzen, verbietet das Gesetz nicht.
Videosysteme, die der Unterhaltung dienen, erfordern keine besondere Genehmigung und müssen auch bei keiner Behörde angemeldet
werden. Jedermann kann Straßen und Gebäude und die dort befindlichen Personen filmen. Personen, die wissen, dass sie aufgenommen
werden, können jederzeit verlangen, dass ihr Bild gelöscht wird. Wenn
jedoch ausdrücklich beabsichtigt ist, derartige Bilder zu Überwachungszwecken zum Schutz von Personen und/oder Vermögenswerten aufzunehmen, muss eine Genehmigung eingeholt werden.
Das portugiesische Gesetz (besonders die Art. 192 und 199 des Strafgesetzbuches und die Art. 6 und 7 des Datenschutzgesetzes) verbietet:
Aufnahmen im Innern eines Fahrzeugs ohne das Einverständnis der aufgenommenen Personen zu machen (z.B. Angestellte einer Firma ohne deren
Einverständnis aufzunehmen); vom Innern eines Kfz Aufnahmen der Umgebung und von dort befindlichen Personen ohne deren Einverständnis und
ohne vorherige Genehmigung durch die zuständige Behörde zu machen.
Für den Fall, dass Sie die Kamera innerhalb Ihre persönlichen Eigentums anbringen (zum persönlichen Schutz), sollten Sie beim Kauf
sicherstellen, dass das Gerät den gesetzlichen Regeln für diesen Bereich entspricht; der Hersteller muss einen entsprechenden Nachweis
liefern. In einem Strafverfahren können (nach der vorherrschenden
Rechtslehre) derartige Aufnahmen als Beweis genutzt werden, wenn
dies von einem Richter genehmigt wurde, der die besonderen Umstände des Falles geprüft hat. Im portugiesischen Recht kann nicht davon ausgegangen werden, dass Videoaufnahmen eines Ereignisses als
Beweis oder Teil eines Beweises genutzt werden können. Die besonderen Umstände des Falles müssen jeweils gesondert geprüft werden
um festzustellen, ob Bilder genutzt werden können oder nicht.
Tatsächlich können Videoüberwachungssysteme, die dem Schutz
von Personen und Eigentum dienen, von jedermann im Privatbereich
genutzt werden. Irgendeine besondere Genehmigung oder Anmeldung bei irgendeiner Behörde ist nicht notwendig, solange diese
Überwachungssysteme öffentliche Straßen, fremdes Eigentum oder
Angestellte nicht aufnehmen können.
Auch wenn die Einrichtung und das Betreiben von Videoüberwachungssystemen im privaten Bereich (wie oben beschrieben) nicht meldepflichtig
ist, gibt es doch in noch laufenden Verfahren entgegengesetzte richterliche
Entscheidungen hinsichtlich des Gebrauchs von derartigen Aufnahmen. Es
ist daher empfehlenswert, die Einzelheiten der Installation von Videoüber-

wachungssystemen auch im privaten Bereich der CNPD mitzuteilen um
sicherzustellen, dass die Systeme korrekt angebracht sind.
Firmen, die derartige Geräte und Ausrüstungen verkaufen, müssen
von der CNPD zugelassen sein. Ist ein Gerät auf portugiesischem Territorium zum Verkauf zugelassen und legal, bedeutet dies nicht, dass
es für jegliche Zwecke benutzt werden darf. Es darf nicht benutzt werden, um gesetzwidrig Daten zu sammeln.
Die CNPD erlaubt gegenwärtig Privatleuten oder Privatunternehmen nicht, im öffentlichen Bereich Aufnahmen zu machen, die die
Identifizierung bestimmter Personen möglich machen. Daher sagt die
CNPD, dass aus einem Auto Bilder durch eine Dashcam dann nicht gemacht werden dürfen, wenn eine Person
direkt oder durch persönliche Daten wie
z.B. ein Autokennzeichen identifiziert
werden kann.

Oil in the Algarve - saviour or threat?
There has been much coverage in the press over recent months about the issue of oil exploration in Portugal and many people of course have very
strong views on the subject. We have been asked by a few Members if we have any information about fracking and also about the current state of
affairs in the Algarve. afpop MC member Paul Rees is the publisher of the Algarve Daily News and has covered the issue since the beginning. We have
asked him to provide an overview for Members’ information, which we are pleased to reproduce here.
Fifteen oil and gas exploration contracts between the government and
major oil companies have been signed, another three currently are being finalised. The contracts cover much of the sea between Oporto and Vila Real
de Santo António and allow the companies to explore for, drill for and extract oil and gas. A clause in the contracts states that the contract details can
never be changed. The companies involved are Repsol, Galp, ENI, Kosmos
Energy, Partex for offshore, with Australis and Portfuel having contracts for
onshore areas including much of the Algarve.
These contracts cover all sections of the offshore and onshore oil and
gas exploration process, from initial studies and exploration (2D and 3D
seismic surveys) to full production and abandonment, and finally ‘environmental rehabilitation.’
The concession blocks cover much of Portugal’s offshore territory, with
onshore concessions impacting all but two of the Algarve’s council areas,
Alcoutim and Castro Marim.
The contracts are similar. One exception is in the offshore contract with
Repsol/Partex where there are special clauses giving them the guarantees
that any future changes shall not have a negative economic impact in their
operations, and in the onshore ones where a special provision for the use of
Hydraulic Fracturing, (fracking), and other ‘unconventional technologies’ is
included. The use of such technology is restricted and subject to approval
by the National Entity for the Fuel Market (ENMC). Currently, each concession holder claims that its use of fracking is not foreseen.
However, approval for fracking may be granted once the concessionaires
convince the ENMC that it is the most suitable technology. Approval criteria
include a positive Environmental Impact Assessment and an outcome from
public consultations that includes overall positive feedback from both the
public and local councils, although ultimately the government takes a view
on both and decides matters “in the public interest.”
Portfuel’s initial work schedule in the Algarve is to analyse rock samples
and define the geology of the area, with drilling planned for 2019. Should
Portfuel want to use fracking or other unconventional technologies, it must
follow the appropriate procedural process.
Portfuel’s owner Sousa Cintra says that at this exploration phase it is impossible for environmental contamination to occur and if there was oil or
gas, this would be “good news, because it would mean that we had found a
source of wealth in the country.”
Luis Guerreiro from Partex agrees that finding oil or natural gas
would be good news for Portugal. “Our energy bill corresponds to 3% of
GDP. If Portugal did not have to import oil or natural gas this would save
eight billion dollars annually” says Guerreiro, adding that there is “no
environmental impact.”
The Ministry of the Economy’s stance is currently - “These are technical studies, not intrusive ones and they do not imply environmental
risks.” The Prime Minister António Costa’s stance is that “contracts are
in place and have to be fulfilled” and “it is essential for the country to
know its natural resources.”
The Algarve’s population was unaware that offshore exploration contracts had been granted and found out too late that the royalty rates agreed
offered little prospect of the Algarve benefitting from oil income as promulgated by the industry. Then onshore contracts were awarded and smouldering resentment turned into fiery reaction.
Furthermore, the onshore blocks were awarded to Portfuel without following a competitive tender process and without reference to, or consultation with, the public or local councils.
When the news was released that the Algarve has been divided into two
large exploration blocks, people started to take notice as the prospect of
“oil rigs in a field near you” grabbed their attention.
The environmental arguments against an offshore oil or gas business focus on the fragile nature of the rock and the proven increase in earthquake
activity caused by drilling, the further limiting of fishing grounds, the environmental impact on marine life, the threat of accident and spillage in a
tourist area dependent on pristine waters and clean beaches, and the visual
impact of oil rigs along the Algarve’s immediate offshore.
The economic arguments against offshore drilling and oil extraction in
the ‘Algarve basin’ area are that, at between 10 cents and 25 cents per barrel,
after all set-up costs have been recovered, the income to the Treasury could
at best be minimal and at worst, insultingly low. Onshore jobs are expected
to be concentrated in the existing hydrocarbon processing plants in Sines,
and near the Spanish town of Huelva where Repsol intends to transport any
Algarve gas it finds. Jobs on offshore rigs are likely to go to experienced
personnel not subject to the Portuguese tax system.
The arguments against an onshore oil or gas business focus on the effects on tourism as tourists and drilling rigs do not mix. The need for processing plant and heavy transport with noise pollution will accompany
probable contamination of the Algarve’s underground water system from
injected fracking fluids, should fracking be authorised.
In January, the first public consultation meeting in the Algarve was hosted by the ENMC and oil company representatives. This was marked by the
audience’s well-informed questioning and depth of feeling against Big Oil
with the industry panel unable to hold its own under heavy fire.
The Algarve’s mayors reiterated that they would take all legal avenues
to stop this threat to Algarve tourism and arranged to meet government
representatives at the end of January.

Öl in der Algarve - Bedrohung oder Rettung?
In der Presse war in den letzten Monaten viel zu Ölbohrungen in Portugal zu lesen, und viele Leute stehen diesen Plänen kritisch gegenüber.
afpop-VR-Mitglied Paul Rees hat als Herausgeber der Algarve Daily News diese Vorhaben seit Beginn verfolgt und gibt uns hier einen Überblick.
Fünfzehn Verträge zur Öl- und Gassondierung sind zwischen der Regierung und größeren Ölfirmen abgeschlossen worden, weitere drei stehen
kurz vor ihrem Abschluss. Die Verträge decken große Seegebiete zwischen
Porto und Vila Real de Santo António ab und erlauben den Firmen nach Öl
und Gas zu suchen, zu bohren und zu fördern. Eine Klausel in den Verträgen
bestimmt, dass deren Einzelheiten nicht mehr geändert werden können.
Die beteiligten Firmen sind Repsol, Galp, ENI, Kosmos Energy, Partex für den Offshorebereich, während Australis Oil & Gas und Portfuel
Verträge für Bohrungen auf dem Festland haben, die auch große Teile
der Algarve einschließen.
Mit den Verträgen sind alle Bereiche der On- und Offshore-Suche nach
Öl und Gas abgedeckt, beginnend mit ersten Untersuchungen (seismische
Vermessungen) bis hin zur vollen Produktion und anschließender Rekultivierung. Die Konzessionsbereiche umfassen viele von Portugals Offshoregebieten, während die Onshore-Konzessionen alle Concelhos der Algarve
betreffen, ausgenommen Alcoutim und Castro Marim.
Die Verträge ähneln sich, ausgenommen der Offshore-Vertrag mit Repsol/Partex mit besonderen Klauseln, die garantieren, dass künftige Änderungen für sie keinerlei negative wirtschaftliche Auswirkungen haben
werden; in den Onshore-Verträgen gibt es eine Sonderregelung für das
Fracking und andere „unkonventionelle Technologien“. Der Gebrauch dieser Technologien ist beschränkt und bedarf der Genehmigung durch die
ENMC (Entidade Nacional para o Mercado de Combustíveis). Zur Zeit erklären
alle Konzessionäre, dass Fracking nicht geplant ist.
Die Genehmigung für das Fracking könnte jedoch erteilt werden,
wenn einer der Konzessionäre die ENMC davon überzeugt, das dies
die geeignetste Methode ist. Bedingungen wären eine positive Beurteilung der Auswirkungen auf die Umwelt und öffentliche Anhörungen mit positiven Rückmeldungen sowohl der Bevölkerung als auch
der Kreisräte, obwohl letztendlich die Regierung beides beurteilt und
im „öffentlichen Interesse“ entscheidet. Die Planung von Portfuel in
der Algarve beginnt mit der Analyse von Gesteinsproben und der
Geologie des Gebietes, Bohrungen sind für 2019 geplant. Sollte Portfuel Fracking oder andere unkonventionelle Techniken nutzen wollen,
muss dem die hier beschriebene Prozedur vorausgehen.
Sousa Cintra, Eigentümer von Portfuel, sagt, dass in dieser Erkundungsphase Umweltschäden nicht möglich seien und wenn es Öl oder Gas gebe,
wäre dies eine „gute Neuigkeit, weil es bedeutete, dass man in diesem Land
eine Quelle des Reichtums gefunden hätte.“
Luis Guerreiro von Partex findet auch, dass die Entdeckung von Öl oder
Gas gute Nachrichten für Portugal wären. „Unsere Energierechnung entspricht 3 % des Bruttoinlandsprodukts. Wenn Portugal Öl oder Gas nicht
importieren müsste, könnten jährlich 8 Mrd. Dollar eingespart werden.“
Und er fügt hinzu, dass es „keine Auswirkungen auf die Umwelt“ gebe.
Die Haltung des Wirtschaftsministeriums ist gegenwärtig „Dies sind
technische Studien, sie greifen nicht in die Umwelt ein und stellen kein Risiko dar.“ Ministerpräsident António Costa meint, „die Verträge sind abge-

schlossen und müssen erfüllt werden“ und „es ist wichtig für das Land, seine
natürlichen Ressourcen zu kennen“.
Die Bevölkerung der Algarve wusste nicht, dass diese Verträge abgeschlossen wurden und fand zu spät heraus, dass die Algarve von den vereinbarten Förderabgaben wohl nicht so profitieren würde wie angekündigt. Dann kamen die Onshore-Verträge dazu und schwelender Unmut
wandelte sich in offene Wut. Außerdem wurden die Onshore-Förderrechte
ohne Ausschreibung und ohne Anhörung bzw. Beratung mit der Bevölkerung oder den örtlichen Kreisräten an Portfuel vergeben. Als bekannt
wurde, dass die Algarve in zwei große Fördergebiete aufgeteilt worden
war, wurden die Leute aufgerüttelt, da die Aussicht auf „Förderanlagen vor
Deiner Nase“ ihre Aufmerksamkeit erregte.
Die Umwelt-Argumentation gegen Offshore-Öl- oder Gasförderung
konzentriert sich auf die fragile Natur der Felsen und die nachgewiesene
Erhöhung der Erdbebenaktivität durch Bohrungen, den weiteren Verlust
von Fischgründen, die Auswirkungen auf das marine Leben, die Bedrohung
durch Unfälle und Öllecks in einem Touristengebiet, das auf klares Wasser
und saubere Strände angewiesen ist sowie die optische Wirkung von Bohrplattformen unmittelbar entlang der Algarveküste.
Die wirtschaftlichen Argumente gegen die Offshore-Ölsuche und -förderung im „Algarve-Becken“ sind, dass bei 10 – 25 Cent/Barrel nach Abzug
aller Kosten die Einnahmen des Finanzministeriums bestenfalls minimal,
im schlechtesten Fall geradezu unverschämt niedrig wären. Arbeitsplätze
auf dem Land würden wahrscheinlich vor allem bei dem bereits existierenden Raffineriekomplex in Sines entstehen sowie bei der spanischen Stadt
Huelva, wohin Repsol das in der Algarve geförderte Gas bringen möchte.
Arbeitsplätze auf Bohrinseln gehen wahrscheinlich an erfahrenes Personal,
das in Portugal keine Steuern zahlen würde.
Die Argumente gegen eine Öl- oder Gasförderung an Land gründen sich auf die Auswirkungen auf den Tourismus, da dieser und Ölförderanlagen nicht miteinander harmonieren. Sollte Fracking erlaubt
werden, würde zur wahrscheinlichen Kontamination des algarvischen
Grundwassersystems durch die eingespritzten Fracking-Chemikalien zusätzlich die Notwendigkeit von Verarbeitungsanlagen und
Schwertransporten mit Lärmbelästigung kommen.
Im Januar wurde die erste öffentliche Anhörung in der Algarve von der
ENMC und Repräsentanten der Ölindustrie abgehalten. Die Industrievertreter konnten den Fragen der sehr gut informierten Zuhörer und der tiefgehenden Ablehnung von „Big Oil“ nicht standhalten. Die Bürgermeister
der Algarve wiederholten, dass sie alle gesetzlichen Mittel nutzen würden,
diese Bedrohung des algarvischen Tourismus zu stoppen und vereinbarten
für Ende Januar ein Treffen mit Regierungsvertretern.

cards – is this necessary? What can you do to reduce the environmental
damage caused by the wood industry and our demand?
Carefully analysing if you really need to print the document you are
reading on your laptop is an important first step - is it really important to
have a hard copy? If you can’t avoid printing, use recycled paper or FSC
certified paper (Forest Stewardship Council). The FSC certification gives
you as a customer the option to choose a forest product like paper or
wood that has been sourced in an environmentally friendly, socially responsible and economically viable manner. The FSC was founded in 1993
and its main goal is to reduce deforestation. Forests cover 31% of our
planet which are vitally needed to provide our world with oxygen, apart
from also being an important home for people and wildlife. Deforestation causes a huge imbalance in our world-climate and biodiversity. It is
estimated that 15% of all greenhouse
gas emissions are the result of deforestation. For example 17% of the forest
in the Amazon has been destroyed in
the last 50 years. When we take into
account that one tree provides oxygen
for 3 people, 17% has a huge impact
on our oxygen reservoir.
But what are the alternatives?
What else can we use for paper, furniture and building materials? There
are many alternatives of fast growing
trees to satisfy the world’s demand
for wood. Many people still believe
that they need to use hard wood for
their construction, but as sustainable
architects with over 16 years’ experience we can assure you that there are
alternatives. The best experiences we

growing, doesn’t deplete the soil and
it fulfils many design requirements.

deforestation does not harm our ecological balance.
In only 5 years a bamboo plant grows around 200 bamboo shoots,
in comparison with a local tree which would achieve only a few metres
of a thin tree trunk.

stetig zu. Es scheint unfassbar, dass selbst in der Generation von E-Büchern
und E-Mails der Papierverbrauch sich in den letzten 5 Jahren verdoppelt hat
und es wird erwartet, dass die Nachfrage exponentiell steigt.
Der durchschnittliche tägliche Web-Benutzer druckt 28 Seiten pro
Tag (Quelle: Gartner Gruppe und HP)! 10.000 Bäume werden allein in
China jährlich gefällt, nur um den Papierbedarf für Ansichtskarten zu

Erfahrungen haben wir mit der Bambuspflanze gemacht. Bambus wächst schnell, laugt unsere Böden
nicht aus, erfüllt jegliche Design-Anforderung und

The Event
Mediterrane Garten-Schau
An exciting Mediterranean Garden Show is taking place within the grounds
of VILA VITA Parc Resort & Spa in Porches on 11th/12th of June. Aptly called
The Event, it is being organised by the publishers of the Mediterranean Gardening and Outdoor Living magazine in partnership with VILA VITA, and will
bring together local and international experts who will be giving talks and
holding Q&A sessions about plants and all things gardening. It aims to bring a
Chelsea Flower Show style extravaganza combined with a typical British garden fête, to the Mediterranean. As we will be supporting The Event and also
attending as exhibitors, there will be more information in the April UPDATE
and also soon on our website in
the Community Centre.
One of the activities and
games at The Event will be a
Tug-of-War competition, where
teams of eight will go toe-to-toe
in a fun competition to decide
who are the Algarve Tug-of-War
champs for 2016. We would like
to submit an afpop team and
are looking for volunteers to join
in the fun. Any afpop Members
who are interested in a little physical exercise and in representing afpop in
the competition should contact the afpop office to register their interest and
when we have more information we will contact those interested.
Of course anyone volunteering should be confident that they are healthy
and seek medical advice should they have any health issues. And as an added
incentive, all those selected for the team will qualify for free entrance.

auch an einen Wettbewerb im Tauziehen gedacht. Wir
möchten auch ein
afpop - Team stellen und suchen jetzt nach Mitstreitern. Wer

Natürlich sollten sich die Athleten fit und gesund fühlen und ggf.

Western Algarve
The first few meetings of the new year have gone and were successfully attended.
The next meeting will be 11th March and will be at Campimar Restaurant
at 12.30 for 1. This restaurant is in a picturesque position overlooking the sea at
Porto da Mos. The meal will be fish soup or melon with smoked ham, grilled
golden bream or pork loin with sweet potato puree, fresh fruit salad or chocolate brownie with, of course, the normal drinks included with the meal. Please let
me have your choices when you book. The cost will be €20 and €22 for guests.
Talking of guests, there will be a Leap Day Proposal – no, not marriage
but as a special deal. Any new members joining that day can have joint
membership for the price of a single - €81 instead of the normal €96
(which includes a one-off joining fee of €35) and lapsed members can
rejoin as 2 for 1 without the €35 joining fee, making it a very attractive
€46 for joint membership. I am looking to have this as a coffee morning from 10.30 – 1pm at Ti Rosa in Lagos, a small café which is behind
the Adega da Marina, so please tell your friends and neighbours and
bring them along to sign up with me on 29th February – and you will
still receive your €5 bonus per membership so you cannot get a better
proposal than that! Or just come along and chat to me whilst having a
convivial coffee. I will be there through those times - come and hear my
plans for the next afpop trip which is being organised as I write. Coimbra will be the destination and I am sure it will prove as popular as the
other trips have been.
The year seems to be running away with me already but I will try and get
your social calendar filled up for you with events in the Lagos area and
hope to see you at some of them soon.

Unsere ersten Treffen des neuen Jahres waren gut besucht.
Am 11. März sehen wir uns um 12.30 h im Restaurant Campimar. Das
Restaurant liegt sehr hübsch am Strand Praia de Mós. Es gibt Fischsuppe
oder Melone mit Schinken, gegrillte Dourade oder Schweinefilet mit
Süßkartoffelpüree, frischen Obstsalat oder Schokoladen-Brownie und
natürlich die üblichen Getränke zum Essen. Geben Sie mir bitte Ihre Wünsche bei der Buchung an, es kostet € 20, für Gäste € 22.
Zum Thema Gäste gibt es einen Vorschlag zum Schalttag – nein, keine
Hochzeit, sondern ein besonderes Schnäppchen: wer an diesem Tag afpop beitritt, bekommt die Doppelmitgliedschaft zum Preis der Einzelmitgliedschaft, d.h. € 81 statt € 96 (die einmalige Beitrittsgebühr von € 35
ist enthalten). Ehemalige Mitglieder können wieder eintreten, ohne die
Beitrittsgebühr von € 35 bezahlen zu müssen, ebenfalls zu zweit für den
Preis der Einzelmitgliedschaft, d.h. € 46 für beide. Ich möchte dies im Rahmen eines Kaffeemorgens von 10.30 h – 13.00 h im Ti Rosa in Lagos
durchführen, ein kleines Café hinter der Adega da Marina. Also reden Sie

March 9th we are in the Portimão Catering College.
Route directions: From A22/EN 125 direction Aqua, passing this, at the next
roundabout (Retail Center) bear right and at the Max Mat roundabout turn
left, passing the GNR HQ. At the following roundabout (fuel station) turn
right in the direction of Pedra Mourinha, after about 150 metres before
MSCar show room turn left and then immediately right into the dead-endstreet. The first and only turnoff to the right leads to the school, a big yellow
two floor building. Parking is available on the left directly after the turnoff.

I can’t believe we are already into February, but there again, Graeme and
I did spend the end of December and nearly all of January touring Australia, New Zealand and the Cook Islands, so I should probably be saying
in a strong Aussie accent “G’Day” and “no worries” but most of all a very
belated Happy New Year!
As you can imagine being away for nearly 6 weeks it hasn’t given me
much time to plan events for the start of 2016. Even though the finer details have not yet been finalized, I have a few dates for your diaries. I am
currently in negotiation with several venues and full details will be available in my future Newsletters or on the afpop website.
March 27th Easter Sunday Lunch: I am in discussion with a venue in
Faro that overlooks the Ria Formosa with a truly amazing view from their
upper restaurant and balcony area. I have Colin Burgess lined up to play
the Saxophone so a good way to spend Easter Sunday.
June 24th Summer Ball with live music from
the Dixie Kings. I have two venues in mind.
I am hoping to be able to have another Full Moon
Party Night on either the 19th July or the 18th
August. I have to find out if the students at the college will come in again during their summer break
and cater for us, as well as let us use their outside
atrium. Last year was the first time we held this
event, we had live music and it was quite magical
with 145 guests eating by the light of the moon and candles!
Pat Allen (West Algarve) and I are in the early stages of discussing the possibility of another Joint Trip where the East & West Members join forces.
Once we know what we are doing we will share it with you!
On the last Wednesday of each month a number of afpop members meet informally at Pedras da Rainha Club House, just outside
Tavira, for the Member-2-Member Coffee / Book Club morning.

Ostalgarve
Ich kann kaum glauben, dass wir schon Februar haben, aber nachdem
Graeme und ich von Ende Dezember und fast den ganzen Januar
in Australien, Neuseeland und auf den Cook-Inseln waren, sind wir
wieder hier, und so wünsche ich Ihnen allen ein sehr verspätetes gutes
Neues Jahr.
Wie Sie sich vorstellen können, hatte ich nicht viel Zeit, für Anfang
2016 zu planen. Aber auch wenn noch Einzelheiten fehlen, so habe
ich doch schon einige Daten für Ihren Kalender. Zur Zeit spreche ich
noch mit verschiedenen Lokalen, Näheres erfahren Sie dann in meinen Rundbriefen oder von der afpop - Website.
27. März, Ostersonntags-Essen: ich verhandle mit einem Restaurant in Faro, das von seinem oberen Raum und dem Balkonbereich
einen wirklich phantastischen Blick über die Ria Formosa bietet. Ich
konnte Colin Burgess zum Saxophonspielen gewinnen, das wird also
ein schöner Ostersonntag.
24. Juni, Sommerball mit Livemusik von den Dixie Kings. Dafür habe
zwei Möglichkeiten im Auge.
Ich hoffe auch, eine weitere Vollmond-Partynacht entweder am
19. Juli oder 18. August organisieren zu können. Ich muss aber erst
herausfinden, ob die Schüler der Hotelfachschule wieder während
ihrer Sommerpause kommen und uns bewirten wollen und ob wir
wieder das Atrium benutzen können. Letztes Jahr haben wir dies
zum ersten Mal veranstaltet, mit Livemusik, und es war eine ziemlich
magische Nacht mit 145 Gästen, die bei Mondlicht und Kerzenschein
gegessen haben!
Pat Allen von der Westalgarve und ich sind in der Vorplanung für eine
weitere gemeinsame Fahrt von Ost & West. Sobald wir Genaueres wissen,
geben wir Bescheid.
Verschiedene afpop - Mitglieder treffen sich informell am letzten
