TENTANG
PENYEDIAAN, PEMANFAATAN, DAN PEMBANGUNAN STATISTIK
Sadan Pusat Statistik Republik Indonesia (selanjutnya disebut sebagai BPS)
dan Kementerian Keuangan Republik Demokratik Timor-Leste (selanjutnya
disebut sebagai Kementerian) dan selanjutnya secara bersama-sama disebut
sebagai PARA PIHAK.
BERKEINGINAN untuk membangun kerja sama teknis yang baik atas dasar
prinsip-prinsip kesetaraan, saling menguntungkan, dan keuntungan tambahan
bagi kedua negara;
MENGINGAT
pentingnya kerja
sama
untuk meningkatkan penyediaan,
pemanfaatan, dan pengembangan statistik di bidang sosial, ekonomi dan
produksi untuk peningkatan kondisi ekonomi dan sosial kedua negara;
MENGETAHUI bahwa PARA PIHAK telah bekerja sama dengan itikad baik
pada awal program dan bahwa siswa telah dipilih dan memulai studi mereka;
SELANJUTNYA MENGETAHUI bahwa sebagai akibat dari telah dimulainya
kerja sama, bahwa PARA PIHAK akan memperlakukan Memorandum Saling
Pengertian ini seolah-olah mulai berlaku sejak dimulainya kerja sama;
MEMPERHATIKAN Komunike Bersama dalam Hubungan Diplomatik antara
Republik Indonesia dan Republik Demokratik Timor-Leste yang ditandatangani
di Jakarta, 2 Juli 2002;
BERDASARKAN atas hukum dan peraturan yang berlaku di masing-masing
negara;

TELAH MENYETUJUI sebagai berikut:
Pasal 1
TU JUAN
PARA PIHAK akan bekerja sama dalam hal yang berkaitan dengan
penyediaan, pemanfaatan, dan pembangunan statistik di bidang sosial,
ekonomi dan produksi yang saling menguntungkan kedua negara, dengan
tujuan khususnya untuk:
a.
Mengembangkan landasan yang kokoh bagi hubungan kedua negara di
masa mendatang;
b.
Melanjutkan pengembangan kerja sama statistik antara kedua negara; dan
c.
Memajukan metode dan standard statistik melalui kursus yang memenuhi
syarat untuk digunakan di kedua negara.
Pasal2
RUANG LINGKUP KERJA SAMA
Ruang lingkup kerja sama antara PARA PIHAK meliputi:
a.
Penyediaan data dan informasi statistik melalui kegiatan statistik berikut:
perencanaan, pengumpulan, pengolahan, tabulasi, penyajian, dan analisis
data dan informasi statistik, yang meliputi bantuan teknis terhadap kegiatan
Survei dan Sensus Penduduk dan Perumahan di Republik Demokratik
Timor-Leste;
b.
Diseminasi dan Pemanfaatan data dan informasi statistik;
c.
Pengembangan sistem informasi statistik;
d.
Pembangunan dan penguatan kapasitas sumber daya manusia dalam
bidang statistik terapan di Sekolah Tinggi llmu Statistik (STIS) dan
pelatihan statistik di Pusat Pendidikan dan Pelatihan BPS; dan
e.
Sebagai bagian dari poin (d) di atas, setiap kursus persiapan yang harus
dilakukan sebelum pendaftaran studi sarjana harus diadakan dan dibayar
secara terpisah di bawah kontrak yang dilakukan dengan orang-orang yang
ditunjuk oleh STIS.
Pasal3
PELAKSANAAN
Pelaksanaan Memorandum Saling Pengertian ini akan diatur lebih lanjut dalam
perjanjian terpisah (selanjutnya disebut sebagai Perjanjian Kerja sama).
Pasal4
KERAHASIAAN
(1)
PARA PIHAK harus menjaga bahwa semua dokumen, informasi, data
ilmiah dan teknis atau data lain yang disediakan, diperoleh atau dihasilkan
dari Memorandum Saling Pengertian ini atau Perjanjian Kerja Sama dijaga
kerahasiaannya
dan
tidak
diberikan
kepada
pihak
ketiga
tanpa
persetujuan tertulis dari PARA PIHAK. Persetujuan tersebut tidak akan
ditunda tanpa alasan yang masuk akal dan jika salah satu Pihak ingin
menunda pemberian persetujuan tersebut maka Pihak tersebut harus
memberikan pemberitahuan secara tertulis dengan menyatakan alasan
menahan persetujuan tersebut.
(2)
PARA PIHAK sepakat bahwa ketentuan Pasal ini akan terus mengikat
PARA PIHAK meskipun Memorandum Saling Pengertian ini berakhir.
(3)
Ketentuan pasal ini tidak akan bertentangan dengan hukum dan peraturan
yang berlaku bagi PARA PIHAK.
Pasal5
PEMBATASAN KEGIATAN PERSONEL
Setiap orang yang terlibat dalam kegiatan yang berkaitan dengan Memorandum
Saling Pengertian ini harus menghormati kemerdekaan politik, kedaulatan, dan
integritas wilayah negara tuan rumah , dan menghindari kegiatan apapun yang
tidak sesuai dengan maksud dan tujuan Memorandum Saling Pengertian ini.
Pasal6
PERUBAHAN
Memorandum Saling Pengertian ini dapat diubah dengan persetujuan tertulis
dari PARA PIHAK. Setiap perubahan akan menjadi bagian yang tidak
terpisahkan dari Memorandum Saling Pengertian ini.
Pasal7
PENYELESAIAN PERSELISIHAN
Setiap perselisihan yang timbul dari penafsiran atau pelaksanaan Memorandum
Saling Pengertian ini akan diselesaikan secara damai melalui konsultasi atau
negosiasi antara PARA PIHAK.
Pasal8
PEMBERLAKUAN, JANGKA WAKTU, DAN PENGHENTIAN
(1)
Memorandum
Saling
Pengertian
ini
mulai
berlaku
pada
tanggal
penandatanganan dan mencakup semua program pendidikan Statistik
Terapan di Sekolah Tinggi llmu Statistik, untuk jangka waktu 5 tahun.
(2)
Memorandum Saling Pengertian ini dapat diakhiri lebih awal dengan
pemberitahuan tertulis dari BPS atau Kementerian, dan pengakhiran
tersebut mulai berlaku 6 (enam) bulan sejak tanggal diterimanya
pemberitahuan.
(3)
Pengakhiran
Memorandum
Saling
Pengertian
ini
tidak
akan
mempengaruhi keabsahan dan jangka waktu setiap program dan proyekproyek yang sedang berjalan di bawah Perjanjian Kerja Sama apapun.
SEBAGAI BUKTI, yang bertandatangan di bawah ini, diberi kuasa oleh
pemerintah masing-masing negara, telah menandatangani Memorandum
Saling Pengertian ini.
DITANDATANGANI di Jakarta pada tanggal 30 bulan April tahun 2015, dalam
bahasa Indonesia, Portugis, dan lnggris, semua naskah berkekuatan hukum
sama. Dalam hal terjadi perbedaan penafsiran, naskah bahasa lnggris yang
berlaku.

O BPS-Statistics Indonesia da Republica da Indonesia (daqui em diante
referido coma BPS) e o Ministerio das Finarn;:as da Republica Democratica de
Timor-Leste (doravante referido coma o Ministerio) e doravante referidos em
conjunto coma as Partes.
DESEJANDO estabelecer uma coopera<;ao amigavel e tecnica com base nos
princfpios de igualdade, beneficio mutuo e vantagens adicionais para ambos os
pafses;
CONSIDERANDO a importancia da coopera<;ao para promover o fornecimento,
utiliza<;ao e desenvolvimento das estatfsticas na esfera social, econ6mica e de
produ<;ao em dire<;ao a melhoria da condi<;ao econ6mica e social de ambas as
Partes;
RECONHECENDO que as Partes, numa base de boa-fe, ja iniciaram a sua
coopera<;ao tendo os alunos sido selecionados e iniciado os seus estudos;
AINDA RECONHECENDO que, coma resultado do infcio antecipado, as Partes
irao tratar este Memoranda de Entendimento, coma se tivesse entrado em
vigor na data de infcio da sua coopera<;ao;

Timor-Leste, assinado em Jacarta no dia 2 de Julho de 2002;
DE ACORDO com as leis e regulamentos em vigor nos respectivos pafses;
ACORDARAM no seguinte:
Artiga 1
OBJETIVOS
As Partes cooperarao em questoes pertinentes ao fornecimento, utiliza9ao e
desenvolvimento das estatisticas nas esferas social, econ6mica e de produ9ao
que poderao beneficiar mutuamente os dois pafses, tendo especialmente em
vista:
a.
0 desenvolvimento de uma base s61ida para o futuro das rela96es entre os
dois pafses;
b. A promo9ao do desenvolvimento da coopera<;ao estatfstica entre os dois
paises; e
c.
A promo9ao de metodos estatfsticos e pad roes atraves de cursos
qualificados a serem realizados nos dais paises.
Artiga 2
AREA DE COOPERA<;AO
As areas de cooperai;ao entre as Partes incluirao:
a.
0 fornecimento de dados estatfsticos e informa96es atraves das seguintes
actividades estatisticas: planeamento, recolha, processamento, tabula<;ao,
apresenta9ao e analise de dados e informa96es estatisticas, que abranjam
a assistencia tecnica ao Censo de Populac;ao e Habitac;ao e lnqueritos
realizados na Republica Democratica de Timor-Leste;
b.
Divulga<;ao e Utiliza9ao de dados estatisticos e informa<;oes;
c.
Desenvolvimento de sistema de informac;ao estatistica; e
d.
Desenvolvimento e fortalecimento de capacidades de recursos humanos
em estatistica aplicada na Sekolah Tinggi llmu Statistik (STIS) e forma<;ao
em estatfstica no Centro de Treinamento (Pusat Pendidikan dan Pelatihan
Statistik) no BPS-Statistics Indonesia;
e.
Como parte do ponto (d) acima, qualquer curso preparat6rio a ser
efetuado antes da inscri9ao no programa de graduai;ao devera ser
acordado e pago separadamente no ambito de um contrato celebrado com
as entidades indicadas pelo STIS.
Artiga 3
IMPLEMENTACAO
A implementa9ao deste Memorando de Entendimento sera prevista em
acordos separados (daqui em diante referidos como Acorda lndependente).
Artiga 4
CONFIDENCIALIDADE
(1) As Partes devem assegurar que todos os documentos, informa96es, dados
cientrficos e tecnicos ou quaisquer outros dados mutuamente prestados,
recebidas ou resultantes no ambito deste Memoranda de Entendimento ou
qualquer Acordo lndependentemente permanecerao confidenciais e nao
serao transmitidos a terceiros sem o consentimento previo e por escrito da
outra Parte. Tai consentimento nao devera ser recusado de forma irrazoavel
e se uma das Partes pretender recusar o consentimento, devera ser
fornecida uma notifica9ao par escrito justificando a nega9ao de tal
consentimento.
(2) As Partes acordam que as disposi96es do presente artigo continua a ser
obrigat6rias entre as Partes, nao obstante a extin9ao do presente
Memorando de Entendimento.
(3) 0
disposto no presente artigo nao obsta
a
aplica9ao das leis e
regulamenta9ao vigentes nas Partes.
Artiga 5
LIMITACAO DE ATIVIDADES PESSOAIS
Qualquer indivfduo envolvido em atividades relacionadas com o presente
Memorando de Entendimento devera respeitar a independencia polftica,
soberania e integridade territorial do pals de acolhimento, e devera evitar
quaisquer atividades incompatfveis com as finalidades e objectivos do presente
Memoranda de Entendimento.
Artigo 6
ALTERA<;OES
Este Memoranda de Entendimento podera ser alterado por consentimento
mutuo por escrito entre as Partes, sendo tais alteracoes parte integrante do
presente Memoranda de Entendimento.
Artigo 7
DETERMINA<;AO DE DISPUTAS
Quaisquer litfgios decorrentes da interpretacao ou implementai;ao do presente
Memoranda de Entendimento serao resolvidos amigavelmente por consulta ou
negociac;ao entre as partes.
Artigo 8
ENTRADA EM VIGOR, DURA<;AO E RESCISAO
(1) 0 presente Memoranda de Entendimento entrara em vigor na data da sua
assinatura e aplicar-se-a igualmente a todos os programas de estatistica
aplicada actualmente a decorrer na Sekolah Tinggi llmu Statistik,
permanecendo em vigor por um periodo de 5 (cinco) anos.
(2) O presente Memoranda de Entendimento podera ser rescindido por meio de
notificacao por escrito por qualquer uma das Partes (BPS ou Ministerio),
devendo tal rescisao produzir os seus efeitos 6 (seis) meses ap6s a
recepi;ao da notificacao.
(3) A rescisao do presente Memoranda de Entendimento nao afetara a validade
e vigencia de quaisquer programas e projectos em curso ao abrigo de
qualquer Acorda lndependente.
EM TESTEMUNHO DE QUE , os abaixo assinados, devidamente autorizados
pelos seus respectivos governos, assinaram o presente Memoranda de
Entendimento
FEITO em duplicado, em Jacarta no dia 30 de Abril, no ano 2015, em
Indonesia, Portugues, e Ingles, sendo todos os textos igualmente autenticos.
Em caso de divergencia de interpreta9ao do presente Memoranda de
Entendimento, o texto em Ingles prevalecera.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE BPS-STATISTICS INDONESIA
OF THE REPUBLIC OF INDONESIA
AND
THE MINISTRY OF FINANCE
OF THE DEMOCRATIC REPUBLIC OF TIMOR-LESTE
CONCERNING
PROVISION, UTILIZATION, AND DEVELOPMENT OF STATISTICS
The BPS-Statistics Indonesia of the Republic of Indonesia (hereinafter referred
to as BPS) and The Ministry of Finance of the Democratic Republic of TimorLeste (hereinafter referred to as the Ministry) and hereinafter collectively
referred to as the Parties.
DESIRING to establish a friendly and technical cooperation on the basis of the
principles of equality, mutual benefit, and supplementary advantage for both
countries;
CONSIDERING the importance of cooperation to promote the provision,
utilization, and development of statistics in social, economy and production
spheres toward the improvement of the economic and social condition of both
Parties;
ACKNOWLEDGING that the Parties have already been cooperating in good
faith on the initiation of the programme and that students have already been
selected and commenced their studies;
FURTHER ACKNOWLEDGING that as a result of the early commencement,
that the Parties will treat this Memorandum of Understanding as if it had come
into effect from the commencement of their cooperation;
TAKING INTO ACCOUNT the Joint Communique Concerning Diplomatic
Relations between the Republic of Indonesia and the Democratic Republic of
Timor-Leste signed in Jakarta, July 2, 2002;
PURSUANT TO the prevailing laws and regulations in the respective countries;
HAVE AGREED as follows:
Article 1
OBJECTIVES
The Parties will cooperate on issues pertinent to the provision, utilization, and
development of statistics in social, economy and production spheres which
would mutually benefit both countries, with a view in particular to:
a.
Developing a firm foundation for future relations between the two countries;
b.
Furthering the development of statistical cooperation between the two
countries; and
c.
Promoting statistical methods and standards through qualified courses to
be used in the two countries.
Article 2
AREA OF COOPERATION
The areas of cooperation between the Parties shall include:
a.
Provision of statistical data and information through the following statistical
activities: planning, collecting, processing, tabulation, presenting, and
analysing of statistical data and information, covering technical assistance
of the Population and Housing Census and Surveys in the Democratic
Republic of Timor-Leste;
b.
Dissemination and Utilization of statistical data and information;
c.
Development of statistical information system;
d.
Development and strengthening of human resources capabilities in applied
statistics at Sekolah Tinggi llmu Statistik (STIS) and statistical training at
BPS-Statistics Indonesia Training Center (Pusat Pendidikan dan Pelatihan
Statistik); and
e. As a part of point (d) above any preparatory course to be done prior to
enrollment to the undergraduate study shall be procured and paid separately
under a contract entered into with individuals appointed by STIS.
Article 3
IMPLEMENTATION
The implementation of this Memorandum of Understanding shall be stipulated
further in separate agreements (here in after referred to as Separate
Agreement).
Article 4
CONFIDENTIALITY
(1) The Parties shall ensure that all documents, information, scientific, and
technical data or any other data mutually provided, received or resulting
under this Memorandum of Understanding or any Separate Agreement
remain confidential and are not transferred to a third party without the prior
written consent of the other Party. Such consent not to be unreasonably
withheld and if one Party wishes to withhold the consent than notice must be
provided in writing stating the grounds for withholding such consent.
(2) The Parties agree that the provisions of this Article shall continue to be
binding between the Parties notwithstanding the termination of this
Memorandum of Understanding.
(3) The provisions of this article shall not prejudice the prevailing laws and
regulation of the Parties.
Article 5
LIMITATION OF PERSONNEL ACTIVITIES
Any person engaged in activities related to this Memorandum of Understanding
shall respect political independence, sovereignty, and territorial integrity of the
host country, and shall avoid any activities inconsistent with the purposes and
objective of this Memorandum of Understanding.
Article 6
AMENDMENT
This Memorandum of Understanding may be amended by mutual written
consent of the Parties. Any amendments will form an integral part of this
Memorandum of Understanding.
Article 7
SETTLEMENTS OF DISPUTE
Any disputes arising from the interpretation or implementation of this
Memorandum of Understanding shall be settled amicably by consultation or
negotiation between the Parties.
Article 8
ENTRY INTO FORCE, DURATION, AND TERMINATION
(1) This Memorandum of Understanding shall enter into force on the date of its
signing and covers all on-going education program in Applied Statistics at
Sekolah Tinggi llmu Statistik, for a period of 5 years.
(2) This Memorandum of Understanding may be terminated early by written
notification of either BPS or the Ministry, and such termination shall take
effect on the date falling 6 (six) months from the date of the receipt of the
notification.
(3) The termination of this Memorandum of Understanding will not affect the
validity and duration of any on-going programs and projects under any
Separate Agreement.
IN WITNESS WHEREOF, the undersigned, duly authorized there to by their
respective governments have signed this memorandum of understanding.
DONE in duplicate in Jakarta on the 301h day of April in the year two thousand
and fifteen in Indonesian, Portuguese, and English, all texts being equally
authentic. In case of any divergence of interpretation of this Memorandum of
Understanding, the English text shall prevail.
